                             SUMMARY

The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.

  Establishes certain requirements related to carbon dioxide
emissions that must be met before applicant seeking to construct
liquefied natural gas terminal may be issued specified permits
and authorizations.

                        A BILL FOR AN ACT
Relating to greenhouse gas emissions.
  Whereas in 2007 the Seventy-fourth Legislative Assembly
declared that it is the policy of this state to reduce greenhouse
gas emissions in Oregon pursuant to specific greenhouse gas
emissions reduction goals; and
  Whereas by 2010, a goal was set to arrest the growth of
Oregon's greenhouse gas emissions and to begin to reduce
greenhouse gas emissions; and
  Whereas by 2020, a goal was set to achieve greenhouse gas
levels that are 10 percent below 1990 levels; and
  Whereas by 2050, a goal was set to achieve greenhouse gas
levels that are at least 75 percent below 1990 levels; and
  Whereas it is the policy of this state for state and local
governments, businesses, nonprofit organizations and individual
residents to prepare for the effects of global warming and by
doing so, prevent and reduce the social, economic and
environmental effects of global warming; now, therefore,
Be It Enacted by the People of the State of Oregon:
  SECTION 1. { +  Before an applicant seeking to construct a
liquefied natural gas terminal is issued a permit to appropriate
water under ORS chapter 537, an authorization for the use of
state lands under ORS chapter 273 or 274 or a permit to remove
any material from the beds or banks of any waters of this state
or fill any waters of this state under ORS chapter 196, the Water
Resources Director and the Director of the Department of State
Lands shall:
  (1) Inform the Director of the State Department of Energy that
an application exists for a permit to appropriate water under ORS
chapter 537, an authorization for the use of state lands under
ORS chapter 273 or 274 or a permit to remove any material from
the beds or banks of any waters of this state or fill any waters
of this state under ORS chapter 196; and
  (2) Approve the application for the permit or authorization
only if the Director of the State Department of Energy issues a
written finding, based on information that has been provided by
the applicant to the Director of the State Department of Energy,
that the carbon dioxide emissions from the liquefied natural gas
terminal will have a mean carbon lifecycle equal to, or less
than, 60 grams of carbon per megajoule with an average range of
55 to 66 grams of carbon per megajoule. + }
  SECTION 2.  { + Section 1 of this 2011 Act applies to permits
to appropriate water under ORS chapter 537, authorizations for
the use of state lands under ORS chapters 273 and 274 and permits
to remove any material from the beds or banks of any waters of
this state or fill any waters of this state under ORS chapter 196
applied for before, on or after the effective date of this 2011
