                             SUMMARY

The following summary is not prepared by the sponsors of the

  Permits Director of Department of Consumer and Business
Services to appoint advisory committee that represents persons
likely to be affected by mortgage lending rules that director
adopts. Requires director to consider suggestions of advisory
committee.
  Declares emergency, effective on passage.

                        A BILL FOR AN ACT
Relating to rules that govern mortgage lending; amending ORS
  86A.172; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1. ORS 86A.172 is amended to read:
  86A.172. Before adopting   { - any - }  rules under ORS 86A.095
to 86A.198, the Director of the Department of Consumer and
Business Services   { - shall consult with an equal number of
persons required to be licensed as mortgage bankers or mortgage
brokers. The director shall consider the suggestions of those
persons in adopting rules under ORS 86A.095 to 86A.198. - }  { +
may appoint and shall consider the suggestions of an advisory
committee that represents the interests of persons that the rules
will likely affect. The director may also use other means to
obtain public views to assist the director in adopting the
rules. + }
  SECTION 2.  { + This 2011 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2011 Act takes effect on its
passage. + }
