A JOINT RESOLUTION

Proposing to enact Section 43 of Article II of the

Constitution of the State of Ohio to prohibit the

General Assembly from enacting certain laws

regarding health care.

BE IT RESOLVED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

Be it resolved by the General Assembly of the State of Ohio,	5
three-fifths of the members elected to each house concurring	6
herein, that there shall be submitted to the electors of the	7
state, in the manner prescribed by law at the general election to	8
be held on November 3, 2009, a proposal to enact Section 43 of	9
Article II of the Constitution of Ohio to read as follows:	10

ARTICLE II	11

43.   The people have the right to enter into private	12
contracts with health care providers for health care services and	13
to purchase private health care coverage. The General Assembly may	14
not require any person to participate in any health care system or	15
plan, nor may it impose a penalty or fine, of any type, for	16
choosing to obtain or decline health care coverage or for	17
participation in any particular health care system or plan.	18

EFFECTIVE DATE	19

If adopted by a majority of the electors voting on this	20
proposal, Section 43 of Article II of the Constitution of Ohio	21
takes effect immediately.	22
