A BILL
To enact section 1541.50 of the Revised Code to 1
establish the State Recreational Vehicle Fund 2
Advisory Board for the purpose of providing advice 3
to the Department of Natural Resources regarding 4
the use of state recreational vehicle money and 5
studying the feasibility of establishing a grant 6
program to fund recreational vehicle projects.7


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 1541.50 of the Revised Code be 8
enacted to read as follows:9

       Sec. 1541.50.  (A) There is hereby created the state 10
recreational vehicle fund advisory board consisting of seven 11
members. Not later than sixty days after the effective date of 12
this section, the director of natural resources shall appoint all 13
of the following members to the board:14

       (1) Two members who shall represent snowmobile users;15

       (2) Two members who shall represent all-purpose vehicle 16
users;17

       (3) Two members who shall represent off-highway motorcycle 18
users;19

       (4) One member who shall represent power sport dealers.20

       Of the initial appointments to the board, two shall serve for 21
a one-year term, two shall serve for a two-year term, and three 22
shall serve for a three-year term. Thereafter, terms of office 23
shall be for three years, with each term ending on the same day of 24
the same month as did the term that it succeeds. Each member shall 25
hold office from the date of appointment until the end of the term 26
for which the member was appointed.27

       (B) After the initial appointments, the director of natural 28
resources shall appoint members of the board in consultation with 29
the following:30

       (1) A list of candidates provided by a recognized statewide 31
organization representing snowmobile users if the member being 32
appointed will replace a member who represents snowmobile users; 33

       (2) A list of candidates provided by a recognized statewide 34
organization representing all-purpose vehicle users if the member 35
being appointed will replace a member who represents all-purpose 36
vehicle users; 37

       (3) A list of candidates provided by a recognized statewide 38
organization representing off-highway motorcycle users if the 39
member being appointed will replace a member who represents 40
off-highway motorcycle users; 41

       (4) A list of candidates provided by a recognized statewide 42
organization representing power sport dealers if the member being 43
appointed will replace a member who represents power sport 44
dealers. 45

        Two weeks prior to the expiration of a member's term of 46
office, or as soon as possible prior to or after a vacancy on the 47
board, an applicable organization shall submit a list of 48
candidates for the position.49

       (C) Members may be reappointed. Any member appointed to fill 50
a vacancy occurring prior to the expiration date of the term for 51
which the member was appointed shall serve for the remainder of 52
that term. A member shall continue to serve subsequent to the 53
expiration date of the member's term until the member's successor 54
takes office or until a period of sixty days has elapsed, 55
whichever occurs first.56

       (D) Serving as a member of the board does not constitute 57
holding a public office or position of employment under the laws 58
of this state and does not constitute grounds for removal of 59
public officers or employees from their offices or positions of 60
employment.61

       (E) A board member shall be reimbursed for actual and 62
necessary expenses incurred in the discharge of duties as a board 63
member.64

       (F) The state recreational vehicle fund advisory board shall 65
provide advice to the department of natural resources regarding 66
the use of state recreational vehicle fund money. The board also 67
shall study the feasibility of establishing a grant program to 68
fund recreational vehicle projects on both public and private 69
lands. Not later than one year after the effective date of this 70
section, the board shall issue a report of its findings and 71
recommendations to the director of natural resources, the 72
president and minority leader of the senate, the speaker and 73
minority leader of the house of representatives, and the 74
chairperson and the ranking minority member of the committee of 75
the house of representatives and the committee of the senate with 76
primary responsibility over issues related to natural resources.77
