A BILL
To amend section 5512.04 and to enact sections 1
122.09 and 166.051 of the Revised Code to require 2
the Director of Development and the 3
Transportation Review Advisory Council, when 4
considering project incentive awards, to provide 5
a point preference to projects located within two 6
miles of a Center of Excellence in Higher 7
Education or located in Ohio Hubs of Innovation 8
and Opportunity or Heritage Ohio Main Street 9
Program communities.10

       Section 1. That section 5512.04 be amended and sections 11
122.09 and 166.051 of the Revised Code be enacted to read as 12
follows:13

       Sec. 122.09. (A) When evaluating projects under this chapter 14
according to any points system established by the director of 15
development, the director shall award an additional number of 16
points equal to one-tenth of the point value the project would 17
have otherwise received if not for this division if the project 18
satisfies any of the following:19

       (1) The project is located within two miles of a university 20
recognized by the chancellor of the Ohio board of regents as a 21
center of excellence in higher education.22

       (2) The project is located within an area designated by the 23
director of development as an Ohio hub of innovation and 24
opportunity for aerospace and innovation.25

       (3) The project is located in a heritage Ohio main street 26
program-member community. The director of development, in the 27
director's sole discretion, shall award points to not more than 28
five projects in such communities.29

       (B) As used in this section, "heritage Ohio main street 30
program-member community" means a township or municipal 31
corporation that is a member of the heritage Ohio main street 32
program, or in which a nonprofit organization is such a member.33

       Sec. 166.051. (A) When evaluating projects under this chapter 34
according to any points system established by the director, the 35
director of development shall award an additional number of points 36
equal to one-tenth of the point value the project would have 37
otherwise received if not for this section, if the project 38
satisfies any of the following:39

       (1) The project is located within two miles of a university 40
recognized by the chancellor of the Ohio board of regents as a 41
center of excellence in higher education.42

       (2) The project is located within an area designated by the 43
director of development as an Ohio hub of innovation and 44
opportunity for aerospace and innovation.45

       (3) The project is located in a heritage Ohio main street 46
program-member community. The director of development, in the 47
director's sole discretion, shall award points to not more than 48
five projects in such communities.49

       (B) As used in this section, "heritage Ohio main street 50
program-member community" has the same meaning as in section 51
122.09 of the Revised Code.52

       Sec. 5512.04. (A) At least once every two years, the 53
director of transportation shall prepare a fiscal forecast 54
predicting or indicating the amount of funding expected to be 55
available for construction of new transportation capacity 56
projects during the period of the forecast. The forecast shall be 57
consistent with the biennial budget approved by the general 58
assembly.59

       (B) The transportation review advisory council shall develop 60
and approve a list of projects that will not cause spending to 61
significantly exceed the funding predicted to be available by the 62
fiscal forecast. In developing its list of projects, the council 63
shall add to the total number of points scored for any project an 64
additional number of points equal to one-tenth of the point value 65
the project would have otherwise received if not for this section, 66
if the project satisfies any of the following:67

       (1) The project is located within two miles of a university 68
recognized by the chancellor of the Ohio board of regents as a 69
center of excellence in higher education.70

       (2) The project is located within an area designated by the 71
director of development as an Ohio hub of innovation and 72
opportunity for aerospace and innovation.73

       (3) The project is located in a heritage Ohio main street 74
program-member community. The director of development, in the 75
director's sole discretion, shall award points to not more than 76
five projects in such communities.77

       (C) As used in this section, "heritage Ohio main street 78
program-member community" has the same meaning as in section 79
122.09 of the Revised Code.80

       Section 2. That existing section 5512.04 of the Revised Code 81
is hereby repealed.82
