A BILL
To amend section 4501.21 and to enact sections 1
4503.86, 5533.261, and 5534.91 of the Revised Code 2
to create the "Juvenile Diabetes Research 3
Foundation" license plate, to designate a portion 4
of Interstate Route 670 as the "Dana G. 'Buck' 5
Rinehart Highway," and to designate a portion of 6
State Route 13 in Knox County as the "William 7
Burgett Highway."8


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 4501.21 be amended and sections 9
4503.86, 5533.261, and 5543.91 of the Revised Code be enacted to 10
read as follows:11

       Sec. 4501.21.  (A) There is hereby created in the state 12
treasury the license plate contribution fund. The fund shall 13
consist of all contributions paid by motor vehicle registrants and 14
collected by the registrar of motor vehicles pursuant to sections 15
4503.491, 4503.492, 4503.493, 4503.494, 4503.496, 4503.498, 16
4503.499, 4503.50, 4503.501, 4503.502, 4503.505, 4503.51, 17
4503.522, 4503.523, 4503.524, 4503.525, 4503.526, 4503.531, 18
4503.534, 4503.545, 4503.55, 4503.551, 4503.552, 4503.553, 19
4503.554, 4503.561, 4503.562, 4503.564, 4503.591, 4503.67, 20
4503.68, 4503.69, 4503.701, 4503.71, 4503.711, 4503.712, 4503.713, 21
4503.72, 4503.73, 4503.732, 4503.74, 4503.75, 4503.751, 4503.85, 22
4503.86, 4503.89, 4503.90, 4503.92, and 4503.94 of the Revised 23
Code. 24

       (B) The registrar shall pay the contributions the registrar 25
collects in the fund as follows: 26

        The registrar shall pay the contributions received pursuant 27
to section 4503.491 of the Revised Code to the breast cancer fund 28
of Ohio, which shall use that money only to pay for programs that 29
provide assistance and education to Ohio breast cancer patients 30
and that improve access for such patients to quality health care 31
and clinical trials and shall not use any of the money for 32
abortion information, counseling, services, or other 33
abortion-related activities. 34

       The registrar shall pay the contributions the registrar 35
receives pursuant to section 4503.492 of the Revised Code to the 36
organization cancer support community central Ohio, which shall 37
deposit the money into the Sheryl L. Kraner Fund of that 38
organization. Cancer support community central Ohio shall expend 39
the money it receives pursuant to this division only in the same 40
manner and for the same purposes as that organization expends 41
other money in that fund.42

        The registrar shall pay the contributions received pursuant 43
to section 4503.493 of the Revised Code to the autism society of 44
Ohio, which shall use the contributions for programs and autism 45
awareness efforts throughout the state. 46

       The registrar shall pay the contributions the registrar 47
receives pursuant to section 4503.494 of the Revised Code to the 48
national multiple sclerosis society for distribution in equal 49
amounts to the northwestern Ohio, Ohio buckeye, and Ohio valley 50
chapters of the national multiple sclerosis society. These 51
chapters shall use the money they receive under this section to 52
assist in paying the expenses they incur in providing services 53
directly to their clients.54

       The registrar shall pay the contributions the registrar 55
receives pursuant to section 4503.496 of the Revised Code to the 56
Ohio sickle cell and health association, which shall use the 57
contributions to help support educational, clinical, and social 58
support services for adults who have sickle cell disease.59

       The registrar shall pay the contributions the registrar 60
receives pursuant to section 4503.498 of the Revised Code to 61
special olympics Ohio, inc., which shall use the contributions for 62
its programs, charitable efforts, and other activities. 63

       The registrar shall pay the contributions the registrar 64
receives pursuant to section 4503.499 of the Revised Code to the 65
children's glioma cancer foundation, which shall use the 66
contributions for its research and other programs. 67

        The registrar shall pay the contributions the registrar 68
receives pursuant to section 4503.50 of the Revised Code to the 69
future farmers of America foundation, which shall deposit the 70
contributions into its general account to be used for educational 71
and scholarship purposes of the future farmers of America 72
foundation. 73

        The registrar shall pay the contributions the registrar 74
receives pursuant to section 4503.501 of the Revised Code to the 75
4-H youth development program of the Ohio state university 76
extension program, which shall use those contributions to pay the 77
expenses it incurs in conducting its educational activities. 78

        The registrar shall pay the contributions received pursuant 79
to section 4503.502 of the Revised Code to the Ohio cattlemen's 80
foundation, which shall use those contributions for scholarships 81
and other educational activities. 82

       The registrar shall pay the contributions received pursuant 83
to section 4503.505 of the Revised Code to the organization Ohio 84
region phi theta kappa, which shall use those contributions for 85
scholarships for students who are members of that organization. 86

        The registrar shall pay each contribution the registrar 87
receives pursuant to section 4503.51 of the Revised Code to the 88
university or college whose name or marking or design appears on 89
collegiate license plates that are issued to a person under that 90
section. A university or college that receives contributions from 91
the fund shall deposit the contributions into its general 92
scholarship fund. 93

        The registrar shall pay the contributions the registrar 94
receives pursuant to section 4503.522 of the Revised Code to the 95
"friends of Perry's victory and international peace memorial, 96
incorporated," a nonprofit corporation organized under the laws of 97
this state, to assist that organization in paying the expenses it 98
incurs in sponsoring or holding charitable, educational, and 99
cultural events at the monument. 100

       The registrar shall pay the contributions the registrar 101
receives pursuant to section 4503.523 of the Revised Code to the 102
fairport lights foundation, which shall use the money to pay for 103
the restoration, maintenance, and preservation of the lighthouses 104
of fairport harbor. 105

       The registrar shall pay the contributions the registrar 106
receives pursuant to section 4503.524 of the Revised Code to the 107
Massillon tiger football booster club, which shall use the 108
contributions only to promote and support the football team of 109
Washington high school of the Massillon city school district.110

       The registrar shall pay the contributions the registrar 111
receives pursuant to section 4503.525 of the Revised Code to the 112
United States power squadron districts seven, eleven, twenty-four, 113
and twenty-nine in equal amounts. Each power squadron district 114
shall use the money it receives under this section to pay for the 115
educational boating programs each district holds or sponsors 116
within this state.117

       The registrar shall pay the contributions the registrar 118
receives pursuant to section 4503.526 of the Revised Code to the 119
Ohio district Kiwanis foundation of the Ohio district of Kiwanis 120
international, which shall use the money it receives under this 121
section to pay the costs of its educational and humanitarian 122
activities.123

       The registrar shall pay the contributions the registrar 124
receives pursuant to section 4503.531 of the Revised Code to the 125
thank you foundation, incorporated, a nonprofit corporation 126
organized under the laws of this state, to assist that 127
organization in paying for the charitable activities and programs 128
it sponsors in support of United States military personnel, 129
veterans, and their families.130

       The registrar shall pay the contributions the registrar 131
receives pursuant to section 4503.534 of the Revised Code to the 132
disabled American veterans department of Ohio, to be used for 133
programs that serve disabled American veterans and their families.134

        The registrar shall pay the contributions the registrar 135
receives pursuant to section 4503.55 of the Revised Code to the 136
pro football hall of fame, which shall deposit the contributions 137
into a special bank account that it establishes and which shall be 138
separate and distinct from any other account the pro football hall 139
of fame maintains, to be used exclusively for the purpose of 140
promoting the pro football hall of fame as a travel destination. 141

        The registrar shall pay the contributions that are paid to 142
the registrar pursuant to section 4503.545 of the Revised Code to 143
the national rifle association foundation, which shall use the 144
money to pay the costs of the educational activities and programs 145
the foundation holds or sponsors in this state. 146

        The registrar shall pay to the Ohio pet fund the 147
contributions the registrar receives pursuant to section 4503.551 148
of the Revised Code and any other money from any other source, 149
including donations, gifts, and grants, that is designated by the 150
source to be paid to the Ohio pet fund. The Ohio pet fund shall 151
use the moneys it receives under this section to support programs 152
for the sterilization of dogs and cats and for educational 153
programs concerning the proper veterinary care of those animals, 154
and for expenses of the Ohio pet fund that are reasonably 155
necessary for it to obtain and maintain its tax-exempt status and 156
to perform its duties. 157

        The registrar shall pay the contributions the registrar 158
receives pursuant to section 4503.552 of the Revised Code to the 159
rock and roll hall of fame and museum, incorporated. 160

        The registrar shall pay the contributions the registrar 161
receives pursuant to section 4503.553 of the Revised Code to the 162
Ohio coalition for animals, incorporated, a nonprofit corporation. 163
Except as provided in division (B) of this section, the coalition 164
shall distribute the money to its members, and the members shall 165
use the money only to pay for educational, charitable, and other 166
programs of each coalition member that provide care for unwanted, 167
abused, and neglected horses. The Ohio coalition for animals may 168
use a portion of the money to pay for reasonable marketing costs 169
incurred in the design and promotion of the license plate and for 170
administrative costs incurred in the disbursement and management 171
of funds received under this section. 172

       The registrar shall pay the contributions the registrar 173
receives pursuant to section 4503.554 of the Revised Code to the 174
Ohio state council of the knights of Columbus, which shall use the 175
contributions to pay for its charitable activities and programs.176

        The registrar shall pay the contributions the registrar 177
receives pursuant to section 4503.561 of the Revised Code to the 178
state of Ohio chapter of ducks unlimited, inc., which shall 179
deposit the contributions into a special bank account that it 180
establishes. The special bank account shall be separate and 181
distinct from any other account the state of Ohio chapter of ducks 182
unlimited, inc., maintains and shall be used exclusively for the 183
purpose of protecting, enhancing, restoring, and managing wetlands 184
and conserving wildlife habitat. The state of Ohio chapter of 185
ducks unlimited, inc., annually shall notify the registrar in 186
writing of the name, address, and account to which such payments 187
are to be made. 188

        The registrar shall pay the contributions the registrar 189
receives pursuant to section 4503.562 of the Revised Code to the 190
Mahoning river consortium, which shall use the money to pay the 191
expenses it incurs in restoring and maintaining the Mahoning river 192
watershed. 193

       The registrar shall pay the contributions the registrar 194
receives pursuant to section 4503.564 of the Revised Code to 195
Antioch college for the use of the Glen Helen ecology institute to 196
pay expenses related to the Glen Helen nature preserve.197

        The registrar shall pay to a sports commission created 198
pursuant to section 4503.591 of the Revised Code each contribution 199
the registrar receives under that section that an applicant pays 200
to obtain license plates that bear the logo of a professional 201
sports team located in the county of that sports commission and 202
that is participating in the license plate program pursuant to 203
division (E) of that section, irrespective of the county of 204
residence of an applicant. 205

        The registrar shall pay to a community charity each 206
contribution the registrar receives under section 4503.591 of the 207
Revised Code that an applicant pays to obtain license plates that 208
bear the logo of a professional sports team that is participating 209
in the license plate program pursuant to division (G) of that 210
section. 211

        The registrar shall pay the contributions the registrar 212
receives pursuant to section 4503.67 of the Revised Code to the 213
Dan Beard council of the boy scouts of America. The council shall 214
distribute all contributions in an equitable manner throughout the 215
state to regional councils of the boy scouts. 216

        The registrar shall pay the contributions the registrar 217
receives pursuant to section 4503.68 of the Revised Code to the 218
great river council of the girl scouts of the United States of 219
America. The council shall distribute all contributions in an 220
equitable manner throughout the state to regional councils of the 221
girl scouts. 222

        The registrar shall pay the contributions the registrar 223
receives pursuant to section 4503.69 of the Revised Code to the 224
Dan Beard council of the boy scouts of America. The council shall 225
distribute all contributions in an equitable manner throughout the 226
state to regional councils of the boy scouts. 227

       The registrar shall pay the contributions the registrar 228
receives pursuant to section 4503.701 of the Revised Code to the 229
Prince Hall grand lodge of free and accepted masons of Ohio, which 230
shall use the contributions for scholarship purposes.231

        The registrar shall pay the contributions the registrar 232
receives pursuant to section 4503.71 of the Revised Code to the 233
fraternal order of police of Ohio, incorporated, which shall 234
deposit the fees into its general account to be used for purposes 235
of the fraternal order of police of Ohio, incorporated. 236

        The registrar shall pay the contributions the registrar 237
receives pursuant to section 4503.711 of the Revised Code to the 238
fraternal order of police of Ohio, incorporated, which shall 239
deposit the contributions into an account that it creates to be 240
used for the purpose of advancing and protecting the law 241
enforcement profession, promoting improved law enforcement 242
methods, and teaching respect for law and order. 243

       The registrar shall pay the contributions received pursuant 244
to section 4503.712 of the Revised Code to Ohio concerns of police 245
survivors, which shall use those contributions to provide whatever 246
assistance may be appropriate to the families of Ohio law 247
enforcement officers who are killed in the line of duty. 248

       The registrar shall pay the contributions received pursuant 249
to section 4503.713 of the Revised Code to the greater Cleveland 250
peace officers memorial society, which shall use those 251
contributions to honor law enforcement officers who have died in 252
the line of duty and support its charitable purposes.253

       The registrar shall pay the contributions the registrar 254
receives pursuant to section 4503.72 of the Revised Code to the 255
organization known on March 31, 2003, as the Ohio CASA/GAL 256
association, a private, nonprofit corporation organized under 257
Chapter 1702. of the Revised Code. The Ohio CASA/GAL association 258
shall use these contributions to pay the expenses it incurs in 259
administering a program to secure the proper representation in the 260
courts of this state of abused, neglected, and dependent children, 261
and for the training and supervision of persons participating in 262
that program. 263

        The registrar shall pay the contributions the registrar 264
receives pursuant to section 4503.73 of the Revised Code to Wright 265
B. Flyer, incorporated, which shall deposit the contributions into 266
its general account to be used for purposes of Wright B. Flyer, 267
incorporated. 268

       The registrar shall pay the contributions the registrar 269
receives pursuant to section 4503.732 of the Revised Code to the 270
Siegel & Shuster society, a nonprofit organization dedicated to 271
commemorating and celebrating the creation of Superman in 272
Cleveland, Ohio.273

       The registrar shall pay the contributions the registrar 274
receives pursuant to section 4503.74 of the Revised Code to the 275
Columbus zoological park association, which shall disburse the 276
moneys to Ohio's major metropolitan zoos, as defined in section 277
4503.74 of the Revised Code, in accordance with a written 278
agreement entered into by the major metropolitan zoos. 279

       The registrar shall pay the contributions the registrar 280
receives pursuant to section 4503.75 of the Revised Code to the 281
rotary foundation, located on March 31, 2003, in Evanston, 282
Illinois, to be placed in a fund known as the permanent fund and 283
used to endow educational and humanitarian programs of the rotary 284
foundation. 285

       The registrar shall pay the contributions the registrar 286
receives pursuant to section 4503.751 of the Revised Code to the 287
Ohio association of realtors, which shall deposit the 288
contributions into a property disaster relief fund maintained 289
under the Ohio realtors charitable and education foundation.290

        The registrar shall pay the contributions the registrar 291
receives pursuant to section 4503.85 of the Revised Code to the 292
Ohio sea grant college program to be used for Lake Erie area 293
research projects. 294

       The registrar shall pay each contribution the registrar 295
receives pursuant to section 4503.86 of the Revised Code to the 296
Ohio chapter of the juvenile diabetes research foundation in whose 297
geographic territory the person who paid the contribution resides.298

       The registrar shall pay the contributions the registrar 299
receives pursuant to section 4503.89 of the Revised Code to the 300
American red cross of greater Columbus on behalf of the Ohio 301
chapters of the American red cross, which shall use the 302
contributions for disaster readiness, preparedness, and response 303
programs on a statewide basis.304

       The registrar shall pay the contributions the registrar 305
receives pursuant to section 4503.90 of the Revised Code to the 306
nationwide children's hospital foundation.307

       The registrar shall pay the contributions received pursuant 308
to section 4503.92 of the Revised Code to support our troops, 309
incorporated, a national nonprofit corporation, which shall use 310
those contributions in accordance with its articles of 311
incorporation and for the benefit of servicemembers of the armed 312
forces of the United States and their families when they are in 313
financial need. 314

       The registrar shall pay the contributions the registrar 315
receives pursuant to section 4503.94 of the Revised Code to the 316
Michelle's leading star foundation, which shall use the money 317
solely to fund the rental, lease, or purchase of the simulated 318
driving curriculum of the Michelle's leading star foundation by 319
boards of education of city, exempted village, local, and joint 320
vocational school districts.321

       (C) All investment earnings of the license plate contribution 322
fund shall be credited to the fund. Not later than the first day 323
of May of every year, the registrar shall distribute to each 324
entity described in division (B) of this section the investment 325
income the fund earned the previous calendar year. The amount of 326
such a distribution paid to an entity shall be proportionate to 327
the amount of money the entity received from the fund during the 328
previous calendar year.329

       Sec. 4503.86. (A) The owner or lessee of any passenger car, 330
noncommercial motor vehicle, recreational vehicle, or other 331
vehicle of a class approved by the registrar of motor vehicles may 332
apply to the registrar for the registration of the vehicle and 333
issuance of "juvenile diabetes research foundation" license 334
plates. An application made under this section may be combined 335
with a request for a special reserved license plate under section 336
4503.40 or 4503.42 of the Revised Code. Upon receipt of the 337
completed application and compliance by the applicant with 338
divisions (B) and (C) of this section, the registrar shall issue 339
to the applicant the appropriate vehicle registration and a set of 340
"juvenile diabetes research foundation" license plates and a 341
validation sticker, or a validation sticker alone when required by 342
section 4503.191 of the Revised Code.343

       In addition to the letters and numbers ordinarily inscribed 344
on the license plates, "juvenile diabetes research foundation" 345
license plates shall be inscribed with identifying words or 346
markings that are jointly designed and selected by all Ohio 347
chapters of the juvenile diabetes research foundation and approved 348
by the registrar. "Juvenile diabetes research foundation" license 349
plates shall display county identification stickers that identify 350
the county of registration by name or number.351

       (B) The "juvenile diabetes research foundation" license 352
plates and a validation sticker, or validation sticker alone, 353
shall be issued upon receipt of a contribution as provided in 354
division (C)(1) of this section and upon payment of the regular 355
license tax as prescribed under section 4503.04 of the Revised 356
Code, any applicable motor vehicle license tax levied under 357
Chapter 4504. of the Revised Code, any applicable additional fee 358
prescribed by section 4503.40 or 4503.42 of the Revised Code, a 359
bureau of motor vehicles administrative fee of ten dollars, and 360
compliance with all other applicable laws relating to the 361
registration of motor vehicles.362

       (C)(1) For each application for registration and registration 363
renewal notice the registrar receives under this section, the 364
registrar shall collect a contribution of twenty-five dollars. The 365
registrar shall pay this contribution into the state treasury to 366
the credit of the license plate contribution fund created in 367
section 4501.21 of the Revised Code.368

       (2) The registrar shall pay the ten-dollar bureau 369
administrative fee, the purpose of which is to compensate the 370
bureau for additional services required in the issuing of 371
"juvenile diabetes research foundation" license plates, into the 372
state treasury to the credit of the state bureau of motor vehicles 373
fund created by section 4501.25 of the Revised Code.374

       Sec. 5533.261. That portion of the road known as interstate 375
route six hundred seventy, running in an easterly and westerly 376
direction, through the municipal corporation of Columbus in 377
Franklin county, between fourth street and interstate route 378
seventy, shall be known as the "Dana G. 'Buck' Rinehart Highway."379

       The director of transportation may erect suitable markers 380
along the highway indicating its name.381

       Sec. 5534.91. That portion of the road known as state route 382
number thirteen, commencing at the intersection of that route with 383
Cassell road in Knox county and proceeding in a northerly 384
direction to the intersection of that route with Zolman road, 385
shall be known at the "William Burgett Highway."386

        The director of transportation may erect suitable markers 387
along the highway indicating its name.388

       Section 2.  That existing section 4501.21 of the Revised Code 389
is hereby repealed.390

       Section 3.  Section 4501.21 of the Revised Code is presented 391
in this act as a composite of the section as amended by Am. Sub. 392
H.B. 23, Sub. H.B. 206, and Am. S.B. 186, all of the 130th General 393
Assembly. The General Assembly, applying the principle stated in 394
division (B) of section 1.52 of the Revised Code that amendments 395
are to be harmonized if reasonably capable of simultaneous 396
operation, finds that the composite is the resulting version of 397
the section in effect prior to the effective date of the section 398
as presented in this act.399
