A BILL
To amend section 2305.06 of the Revised Code to 1
shorten the period of limitations for actions upon 2
a contract in writing.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 2305.06 of the Revised Code be 4
amended to read as follows:5

       Sec. 2305.06.  Except as provided in sections 126.301 and 6
1302.98 of the Revised Code, an action upon a specialty or an 7
agreement, contract, or promise in writing shall be brought within 8
fifteeneight years after the cause thereofof action accrued.9

       Section 2. That existing section 2305.06 of the Revised Code 10
is hereby repealed.11

       Section 3. Subject to Section 4 of this act, section 2305.06 12
of the Revised Code, as amended by this act, applies to actions in 13
which the cause of action accrues on or after the effective date 14
of this act.15

       Section 4. For causes of action that are governed by section 16
2305.06 of the Revised Code and accrued prior to the effective 17
date of this act, the period of limitations shall be eight years 18
from the effective date of this act or the expiration of the 19
period of limitations in effect prior to the effective date of 20
this act, whichever occurs first.21
