A BILL
To enact section 5902.10 of the Revised Code to 1
require the Director of Veterans Services, upon 2
application by a person who is a veteran or active 3
duty member of any branch of the armed forces of 4
the United States, to issue to the person a 5
military transportation card that entitles the 6
person to travel on any type of public 7
transportation without charge.8


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 5902.10 of the Revised Code be 9
enacted to read as follows:10

       Sec. 5902.10.  (A) As used in this section:11

       (1) "Public transportation" means publicly owned or operated 12
transportation by bus, rail, or other conveyance, that provides to 13
the public transit or paratransit service on a regular and 14
continuing basis within the state, including demand-responsive 15
transportation.16

       (2) "Veteran" means either of the following:17

       (a) A person who served in the armed forces of the United 18
States on active military duty and was discharged from the service 19
under honorable conditions, and who either served on active duty 20
for reasons other than training or, while serving on active duty 21
for training, incurred a disability recognized by the department 22
of veterans affairs or department of defense as service-connected;23

       (b) A person who served in the United States merchant marine, 24
who either served on active duty for reasons other than training 25
or, while serving on active duty for training, incurred a 26
disability recognized by the department of veterans affairs or 27
department of defense as service-connected, and to whom either of 28
the following applies:29

       (i) The person has an honorable report of separation from the 30
active duty military service, form DD214 or DD215;31

       (ii) The person served in the United States merchant marine 32
between December 7, 1941, and December 31, 1946.33

       (B) The director of veterans services shall issue a military 34
transportation card to a person if both of the following apply:35

       (1) The person submits a written application indicating that 36
the person is a veteran or an active duty member of any branch of 37
the armed forces of the United States; and38

       (2) The person submits to the director such documentary 39
evidence that the director prescribes by rule that is sufficient 40
to prove to the director that the person is a veteran or an active 41
duty member of a branch of the armed forces of the United States.42

        The military transportation card shall entitle the person, 43
upon presentation, to board any mode of public transportation and 44
travel on the public transportation without payment of any fee, 45
fare, or charge of any kind. A military transportation card shall 46
be issued at no cost to the person to whom it is issued.47

       (C) A military transportation card issued to a person who is 48
a veteran shall not expire. A military transportation card issued 49
to a person who is an active duty member of a branch of the armed 50
forces of the United States expires on the date the person is 51
scheduled to cease to be such a member as shown in the documentary 52
evidence the person submits to the director at the time of 53
application.54

       (D) The director, in accordance with Chapter 119. of the 55
Revised Code, shall adopt such rules as the director determines 56
are necessary to implement this section.57
