A CONCURRENT RESOLUTION
To invalidate existing rule 3309-1-52 of the 1
Administrative Code, which the School Employees 2
Retirement Board filed for periodic review on 3
March 20, 2013.4


BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES OF THE STATE OF OHIO
(THE SENATE CONCURRING):


        WHEREAS, The General Assembly, under division (G) of section 5
119.032 of the Revised Code, may adopt a concurrent resolution 6
invalidating an existing rule that was filed for periodic review 7
under that section; and8

        WHEREAS, The School Employees Retirement Board filed existing 9
rule 3309-1-52 of the Administrative Code for periodic review 10
under division (E)(2) of section 119.032 of the Revised Code on 11
March 20, 2013; and12

        WHEREAS, The School Employees Retirement Board, in reviewing 13
existing rule 3309-1-52 of the Administrative Code under section 14
119.032 of the Revised Code, did not consider complaints or 15
comments the board had received concerning the rule, as required 16
by divisions (C) and (D) of that section; and17

       WHEREAS, When the School Employees Retirement Board filed 18
existing rule 3309-1-52 of the Administrative Code under division 19
(E)(2) of section 119.032 of the Revised Code, the board failed 20
also to file the travel expense report form that is incorporated 21
by reference into the rule, as required by section 121.73 of the 22
Revised Code; now therefore be it23

        RESOLVED, That, for the reasons set forth in the foregoing 24
findings, existing rule 3309-1-52 of the Administrative Code, as 25
filed for periodic review on March 20, 2013, is invalidated in its 26
entirety; and be it further27

       RESOLVED, That the Clerk of the House of Representatives 28
shall transmit a certified copy of this resolution, together with 29
a certification of the date on which this resolution was adopted, 30
to the School Employees Retirement Board, the Secretary of State, 31
and the Director of the Legislative Service Commission. 32
