A BILL
To amend sections 4139.01, 4139.03, 4139.04, and 1
4139.05 of the Revised Code to revise the law 2
governing Ohio's registered apprenticeship 3
program.4


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That sections 4139.01, 4139.03, 4139.04, and 5
4139.05 of the Revised Code be amended to read as follows:6

       Sec. 4139.01.  As used in sections 4139.01 to 4139.06 of the 7
Revised Codethis chapter:8

       (A) "Apprentice" means a person at least sixteen years of 9
age, except when a higher minimum age standard is otherwise fixed 10
by law, who is covered by anin a registered apprenticeship 11
program to learn a skilled occupation, pursuant to a registered12
apprenticeship agreement.13

       (B) "Apprenticeship agreement" means a written agreement, 14
registered with the Ohio state apprenticeship council, providing 15
for not less than two thousand hours of reasonably continuous 16
employment, and for participation in an approved schedule of work 17
experience through employment, which shall be supplemented by a 18
minimum of one hundred forty-four hours per year of related and 19
supplemental instructions.20

       (C) "Council office" means the unit of the department of job 21
and family services that staffs the apprenticeship council and 22
performs the administrative and oversight functions concerning 23
this state's registered apprenticeship system.24

       Sec. 4139.03.  The apprenticeship council may establish25
recommend minimum standards for apprenticeship programs and may 26
formulate policies and issuerecommend rules as may be necessary 27
to carry out the purpose of sections 4139.01 to 4139.06 of the 28
Revised Codethis chapter. The council shall determine the date 29
and place of its meetings and shall prescribe its own rules of 30
procedure.31

       Sec. 4139.04.  The director of job and family services shall 32
appoint the executive secretary of the apprenticeship council 33
office, which appointment shall be subject to confirmation by a 34
majority vote of the apprenticeship council. The director shall 35
appoint such additional personnel as may be necessary, subject to 36
Chapter 124. of the Revised Code.37

       Sec. 4139.05.  The executive secretary of the apprenticeship38
council office has the following duties:39

       (A) Encourage the voluntary participation of employers and 40
employees in the furtherance of the objective of sections 4139.01 41
to 4139.06 of the Revised Codethis chapter;42

       (B) Register any apprenticeship programs and agreements that 43
meet the minimum standards established by the councilfederal 44
regulations and state rules governing the registered 45
apprenticeship system;46

       (C) Terminate or cancel on the authority ofin consultation 47
with the apprenticeship council any registered apprenticeship 48
programs and agreements not in accordancecompliance with the 49
provisions of such standards;50

       (D) Keep a record of apprenticeship programs and their 51
disposition;52

       (E) Issue certificate of completion of apprenticeship in 53
accordance with the council's standards;54

       (F) Devise and implement all necessary procedures and records55
minimum standards as are necessary for the administration of the 56
registered apprenticeship system;57

       (F) Implement administrative rules adopted by the director of 58
job and family services as necessary for the administration of the 59
registered apprenticeship system;60

       (G) Prepare statistical reports regarding apprenticeship 61
training;62

       (H) Issue information related to apprenticeship;63

       (I) Perform such other duties as the council may direct64
appropriate under the applicable rules and regulations.65

       Section 2. That existing sections 4139.01, 4139.03, 4139.04, 66
and 4139.05 of the Revised Code are hereby repealed.67
