BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. That section 3901.87 of the Revised Code be | 4 |
enacted to read as follows: | 5 |
Sec. 3901.87. (A) No qualified health plan shall provide | 6 |
coverage for a nontherapeutic abortion. | 7 |
(B) As used in this section: | 8 |
(1) "Nontherapeutic abortion" has the same meaning as in | 9 |
section 124.85 of the Revised Code. | 10 |
(2) "Qualified health plan" means any qualified health plan | 11 |
as defined in section 1301 of the "Patient Protection and | 12 |
Affordable Care Act," Pub. L. No. 111-148, offered in this state | 13 |
through an exchange created pursuant to that act. | 14 |
Section 2. (A) It is the purpose of this act to | 15 |
affirmatively opt out of allowing qualified health plans that | 16 |
cover nontherapeutic abortions to participate in Exchanges within | 17 |
this state, as permitted under section 1303 of the "Patient | 18 |
Protection and Affordable Care Act," Pub. L. No. 111-148. | 19 |
(B) As used in this section: | 20 |
(1) "Exchange" means an exchange created pursuant to the | 21 |
"Patient Protection and Affordable Care Act," Pub. L. No. 111-148. | 22 |
(2) "Nontherapeutic abortion" has the same meaning as in | 23 |
section 124.85 of the Revised Code. | 24 |
