BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. That section 123.12 of the Revised Code be enacted | 5 |
to read as follows: | 6 |
Sec. 123.12. (A) As used in this section: | 7 |
(1) "State agency" has the same meaning as in section 1.60 of | 8 |
the Revised Code. | 9 |
(2) "Veteran" means a person who served in the active | 10 |
military, naval, or air service of the United States or reserve | 11 |
components thereof, the Ohio national guard, the Ohio military | 12 |
reserve, or the Ohio naval militia, and who was discharged or | 13 |
released under conditions other than dishonorable. | 14 |
(3) "Veteran-owned small business enterprise" means a sole | 15 |
proprietorship, association, partnership, corporation, limited | 16 |
liability company, or joint venture that is owned and controlled | 17 |
by one or more veterans and is certified as a participant in the | 18 |
veteran-owned small business program by the director of | 19 |
administrative services under this section. | 20 |
(B) The director of administrative services shall establish | 21 |
the veteran-owned small business procurement program. The director | 22 |
shall adopt rules under Chapter 119. of the Revised Code to | 23 |
administer the program that do all of the following: | 24 |
(1) Establish procedures by which a sole proprietorship, | 25 |
association, partnership, corporation, limited liability company, | 26 |
or joint venture may apply for certification as a veteran-owned | 27 |
small business enterprise; | 28 |
(2) Establish standards to determine when a veteran-owned | 29 |
small business enterprise no longer qualifies for veteran-owned | 30 |
small business enterprise certification; | 31 |
(3) Establish annual state agency procurement goals for | 32 |
contracting with veteran-owned small business enterprises in the | 33 |
award of contracts for goods and services under the Revised Code | 34 |
based on the availability of veteran-owned small business | 35 |
enterprises; | 36 |
(4) Develop a process for evaluating and adjusting | 37 |
procurement goals established under this section as necessary to | 38 |
achieve participation goals established by the director; | 39 |
(5) Establish a system to assist state agencies in | 40 |
identifying and utilizing veteran-owned small business enterprises | 41 |
in their contracting processes; | 42 |
(6) Implement an outreach program to educate potential | 43 |
participants about the veteran-owned small business program; and | 44 |
(7) Establish a process for monitoring state agency overall | 45 |
compliance with procurement goals established under this section. | 46 |
The director shall consider the applicable provisions of the | 47 |
Veterans Benefits Act of 2003 (Pub. L. No. 108-183) in order to | 48 |
adopt rules that are consistent with that act. | 49 |
