A BILL
To amend sections 951.02, 951.10, and 951.99 of the 1
Revised Code regarding the liability of owners of 2
certain animals that are running at large.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That sections 951.02, 951.10, and 951.99 of the 4
Revised Code be amended to read as follows:5

       Sec. 951.02.  No person, who is the owner or keeper of 6
horses, mules, cattle, bison, sheep, goats, swine, llamas, 7
alpacas, or geese, shall permit them to run at large in the public 8
road, highway, street, lane, or alley, or upon unenclosed land, or 9
cause suchthe animals to be herded, kept, or detained for the 10
purpose of grazing on premises other than those owned or lawfully 11
occupied by the owner or keeper of suchthe animals.12

       The running at large of any such animal in or upon any of the 13
places mentioned in this section is prima-facie evidence that it 14
is running at large in violation of this section.15

       Sec. 951.10.  The owner or keeper of an animal described in 16
section 951.01 or 951.02 of the Revised Code, who negligently17
permits it to run at large in violation of either of suchthose18
sections, is liable for all damages caused by suchthe animal upon 19
the premises of another without reference to the fence whichthat20
may enclose suchthe premises.21

       Sec. 951.99.  Whoever recklessly violates section 951.01 or22
951.02 of the Revised Code is guilty of a misdemeanor of the 23
fourth degree.24

       Section 2. That existing sections 951.02, 951.10, and 951.99 25
of the Revised Code are hereby repealed.26
