To enact section 3365.16 of the Revised Code to 1
create a subprogram of the Post-Secondary 2
Enrollment Options Program that permits students 3
to participate in certified apprenticeship 4
programs.5


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1.  That section 3365.16 of the Revised Code be 6
enacted to read as follows:7

       Sec. 3365.16.  (A) As used in this section:8

       (1) "Eligible student" means an Ohio resident who is enrolled 9
in a school district, chartered nonpublic school, community 10
school, or STEM school and is at least sixteen years of age.11

       (2) "Apprenticeship program" means any apprenticeship program 12
that is certified or registered by the United States department of 13
labor.14

       (B) There is hereby created a subprogram of the 15
post-secondary enrollment options program under which, beginning 16
with 2014-2015 school year, an eligible student may participate in 17
an apprenticeship program not offered by the student's secondary 18
school. The subprogram shall operate in accordance with rules 19
adopted under division (C) of this section.20

       (C) Not later than December 31, 2013, the chancellor of the 21
Ohio board of regents and the superintendent of public 22
instruction, in consultation with the director of development and 23
the administrator of workers' compensation, shall develop a 24
proposal to implement the subprogram as prescribed by this section 25
and submit it to the state board of education for consideration. 26
Not later than June 30, 2014, upon consideration of that proposal, 27
the state board shall adopt rules, in accordance with Chapter 119. 28
of the Revised Code, to implement the subprogram. The rules shall 29
include at least all of the following:30

       (1) Requirements a student must fulfill in order to 31
participate in the subprogram, including a minimum grade point 32
average of 2.5 out of a 4.0, or its equivalent;33

       (2) A process by which a student may secure an 34
apprenticeship;35

       (3) A process for approval of each student's apprenticeship, 36
including a method for evaluating the educational benefits of the 37
apprenticeship;38

       (4) A stipulation of the maximum number of hours per week a 39
student may work as an apprentice;40

       (5) A method for determining actual costs to a business for 41
participation in the subprogram, including workers' compensation 42
and other insurance costs and training costs;43

       (6) A funding formula for students enrolled in a school 44
district, community school, or STEM school, including a maximum 45
amount, to pay businesses for costs associated with employing 46
students under the subprogram. The amount paid for the subprogram 47
as determined by rule adopted under this section for each 48
participant shall be subtracted from the payments made to the 49
participant's school district under Chapter 3317. of the Revised 50
Code or from the participant's community school or STEM school 51
under section 3314.08 or 3326.33 of the Revised Code.52

       (7) A funding formula for students enrolled in a nonpublic 53
school, including a maximum amount, to pay businesses for costs 54
associated with employing students under the subprogram. The 55
amount paid for each student participating in the subprogram shall 56
be subtracted from moneys specifically appropriated by the general 57
assembly for such purpose.58

       (8) The method for making payments to participating 59
businesses;60

       (9) A method by which credits for a certificate or 61
certificates earned in an apprenticeship under the subprogram may 62
transfer for college credit. Each college shall determine whether 63
or not to accept work credits under the subprogram.64

       (D) Not later than July 1, 2016, and the first day of July 65
every fifth year thereafter, the chancellor and the department of 66
education shall submit a report on the effectiveness of the 67
subprogram to the governor and general assembly in accordance with 68
section 101.68 of the Revised Code.69
