A BILL
To enact section 3313.538 of the Revised Code to 1
permit certain students to participate in 2
interscholastic athletics.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 3313.538 of the Revised Code be 4
enacted to read as follows:5

       Sec. 3313.538. (A) Any student from a country or province 6
outside the United States who attends an elementary or secondary 7
school in this state that accepts the role of the parent in loco 8
parentis or who resides in a dormitory that is owned or operated 9
by the school shall be permitted to participate in 10
interscholastic athletics on the same basis as students who are 11
residents of this state and whose parents reside in this state.12

       (B) No student who attends school in this state shall be 13
denied the opportunity to participate in interscholastic 14
athletics solely because the student's parents do not reside in 15
this state, if the student resides in this state with the 16
student's grandparent, uncle, aunt, or sibling who has legal or 17
temporary custody of the student or is the guardian of the 18
student.19

       (C) No school district, school, interscholastic conference, 20
or organization that regulates interscholastic conferences or 21
events shall have a rule, bylaw, or other regulation that 22
conflicts with this section.23

       (D) As used in this section, "legal custody," "temporary 24
custody," and "guardian" have the same meanings as in section 25
2151.011 of the Revised Code.26
