        Introduced  by  Sen.  RIVERA -- read twice and ordered printed, and when
          printed to be committed to the Committee on Health

        AN ACT to amend the social services law, in relation to requiring  adult
          care  facilities to include certain demographic information in certain
          records maintained by the facility

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section 1.  Subdivision 5 of section 461-e of the social services law,
     2  as  added  by  chapter  601  of  the laws of 1981, is amended to read as
     3  follows:
     4    5. The department may promulgate regulations which require each  adult
     5  care  facility  to  maintain the following written records and any other
     6  such records, under such  conditions  and  for  such  time,  as  may  be
     7  prescribed  pursuant  to such regulations: (i) a chronological admission
     8  and discharge register consisting of a listing of  residents  registered
     9  in  and  discharged  from such facility by name, age, race or ethnicity,
    10  sex of resident, and place from or to which the resident  is  registered
    11  or  discharged, (ii) a daily census record, (iii) a personal non-medical
    12  record for each resident, including but not limited  to,  identification
    13  of  his  or her next-of-kin, family and sponsor, the name and address of
    14  the person or persons to be contacted in the event of an emergency,  and
    15  all details of the referral and registration and non-medical correspond-
    16  ence  and  papers  concerning  the resident, (iv) a financial record for
    17  each resident, including but not limited to, copies of  all  agreements,
    18  resident  account  records  and a current inventory of personal property
    19  being held by the operator.
    20    § 2. This act shall take effect on the ninetieth day  after  it  shall
    21  have become a law. Effective immediately, the addition, amendment and/or
    22  repeal  of  any  rule  or regulation necessary for the implementation of
    23  this act on its effective date are authorized to be made  and  completed
    24  on or before such effective date.
