STATE OF NEW YORK ________________________________________________________________________ 8549 IN SENATE February 13, 2024 ___________ Introduced by Sen. HARCKHAM -- read twice and ordered printed, and when printed to be committed to the Committee on Insurance AN ACT to amend the insurance law, in relation to setting minimum reimbursement for mobile crisis intervention services The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subparagraph (I) of paragraph 35 of subsection (i) of 2 section 3216 of the insurance law is amended by adding a new item (vi) 3 to read as follows: 4 (vi) Reimbursement for covered services provided by a mobile crisis 5 intervention services provider shall be at a rate that is not less than 6 the rate that would be paid for such services pursuant to the medical 7 assistance program under title eleven of article five of the social 8 services law. 9 § 2. Subparagraph (I) of paragraph 5 of subsection (l) of section 3221 10 of the insurance law is amended by adding a new item (vi) to read as 11 follows: 12 (vi) Reimbursement for covered services provided by a mobile crisis 13 intervention services provider shall be at a rate that is not less than 14 the rate that would be paid for such services pursuant to the medical 15 assistance program under title eleven of article five of the social 16 services law. 17 § 3. Paragraph 10 of subsection (g) of section 4303 of the insurance 18 law is amended by adding a new subparagraph (F) to read as follows: 19 (F) Reimbursement for covered services provided by a mobile crisis 20 intervention services provider shall be at a rate that is not less than 21 the rate that would be paid for such services pursuant to the medical 22 assistance program under title eleven of article five of the social 23 services law. 24 § 4. This act shall take effect on the same date and in the same 25 manner as subpart A of part II of chapter 57 of the laws of 2023, takes 26 effect, and shall apply to policies and contracts issued, renewed, modi- 27 fied, altered, or amended on and after such date.
