       Introduced  by  Sen.  LANZA  -- read twice and ordered printed, and when
         printed to be committed to the Committee on Rules
       AN ACT to amend the education  law,  in  relation  to  requiring  school
         districts to have a registered professional nurse in each school
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Paragraph b of subdivision 2 of section 902 of  the  educa-
    2  tion  law,  as amended by chapter 501 of the laws of 2005, is amended to
    3  read as follows:
    4    b. [Any] EVERY such board or trustees [may] SHALL employ [one or more]
    5  school nurses, who shall be registered professional nurses, as  well  as
    6  other  health professionals, as may be required. Such registered profes-
    7  sional nurses and other health professionals shall aid the  director  of
    8  school  health  services  of the district and shall perform such duties,
    9  including health instruction for the benefit of the  public  schools  as
   10  may  be  prescribed  by  such board or trustees, in compliance with each
   11  such health professional's practice  act.    A  REGISTERED  PROFESSIONAL
   12  NURSE  SHALL  BE  REQUIRED  TO BE ON THE PREMISES DURING SCHOOL HOURS AT
   13  EACH SCHOOL WITHIN THE SCHOOL DISTRICT.
   14    S 2. This act shall  take  effect  on  the  first  of  September  next
   15  succeeding the date on which it shall have become a law.
