STATE OF NEW YORK ________________________________________________________________________ 8321 IN SENATE May 11, 2020 ___________ Introduced by Sen. BAILEY -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT in relation to placing a moratorium on closing hospitals during the coronavirus disease 2019 (COVID-19) pandemic; and providing for the repeal of such provisions upon the expiration thereof The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Notwithstanding any provisions of law, rule or regulation 2 to the contrary, due to the coronavirus disease 2019 (COVID-19) pandem- 3 ic, the state shall institute a moratorium on the closure of hospitals 4 until December 31, 2023. As such, no hospital shall close or reduce 5 capacity below the hospital's capacity as of January 1, 2020 before the 6 end of such moratorium. 7 § 2. This act shall take effect immediately and shall expire and be 8 deemed repealed January 1, 2024. EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted.
