Bill Title: Creates the offense of directing sexual conduct between children; provides that a person is guilty of directing sexual conduct by or between children when such person, being eighteen years or older, for the purpose of degrading or abusing such child or children, or for the purpose of gratifying the actor's sexual desire or for monetary gain, directs a child or two or more children, less than thirteen years old, to perform an act or acts of sexual conduct upon themselves or each other.

LANZA -- (at request of the Office of Court Adminis- tration) -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the penal law, in relation to sex offenses against a child or children The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The penal law is amended by adding a new section 130.81 to 2 read as follows: 3 § 130.81 Directing sexual conduct by or between children. 4 A person is guilty of directing sexual conduct by or between children 5 when such person, being eighteen years old or more, for the purpose of 6 degrading or abusing such child or children, or for the purpose of grat- 7 ifying the actor's sexual desire or for monetary gain, directs a child 8 or two or more children, less than thirteen years old, to perform an act 9 or acts of sexual conduct upon themselves or each other. 10 A person directs a child or two or more children to perform an act or 11 acts of sexual conduct upon themselves or each other when the person, 12 acting with the intent that the child or children perform such an act or 13 acts, solicits, requests, commands, importunes or uses physical force or 14 threats of physical force to convince or compel the child or children to 15 perform such act or acts. 16 Directing sexual conduct by or between children shall be deemed to be 17 the highest offense level it would be had the actor, regardless of 18 intent, personally engaged in the act or acts with the child or children 19 that he or she directed the child or children to perform upon themselves 20 or each other. 21 § 2. This act shall take effect on the first of November next succeed- 22 ing the date on which it shall have become a law.
