STATE OF NEW YORK ________________________________________________________________________ 7998 IN SENATE June 2, 2016 ___________ Introduced by Sen. HANNON -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the public health law, in relation to home care worker wage parity The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subparagraph (iv) of paragraph (a) of subdivision 3 of 2 section 3614-c of the public health law, as amended by chapter 56 of the 3 laws of 2016, is amended to read as follows: 4 (iv) for all periods on or after April first, two thousand sixteen, 5 the cash portion of the minimum rate of home care aide total compen- 6 sation shall be ten dollars or the minimum wage as laid out in paragraph 7 [(c)] (a) of subdivision one of section six hundred fifty-two of the 8 labor law, whichever is higher. The benefit portion of the minimum rate 9 of home care aide total compensation shall be four dollars and nine 10 cents. 11 § 2. Subparagraph (iv) of paragraph (b) of subdivision 3 of section 12 3614-c of the public health law, as amended by chapter 56 of the laws of 13 2016, is amended to read as follows: 14 (iv) for all periods on or after March first, two thousand sixteen, 15 the cash portion of the minimum rate of home care aide total compen- 16 sation shall be ten dollars or the minimum wage as laid out in paragraph 17 [(c)] (b) of subdivision one of section six hundred fifty-two of the 18 labor law, whichever is higher. The benefit portion of the minimum rate 19 of home care aide total compensation shall be three dollars and twenty- 20 two cents. 21 § 3. This act shall take effect on the same date and same manner as 22 chapter 56 of the laws of 2016 took effect.
