        Introduced  by  Sen.  LARKIN -- read twice and ordered printed, and when
          printed to be committed to the Committee on Local Government
        AN ACT to authorize the village of Montgomery, in the county of  Orange,
          to discontinue use of certain parkland
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. Subject to the provisions of this act, the village of Mont-
     2  gomery, in the county of Orange, is hereby  authorized,  acting  by  and
     3  through  its  board  of  trustees, to discontinue use as parkland of the
     4  parcel described in section two of this act, and to use such parcel  for
     5  the  installation and operation of solar panels to generate energy to be
     6  used for village purposes.
     7    § 2. The  lands  to  be  discontinued  as  parklands  are  more  fully
     8  described as follows:
     9    ALL  that  parcel  of land, lying, situate and being in the Village of
    10  Montgomery, Town of Montgomery, County of Orange, State of New York, and
    11  being more accurately described as follows:
    12    BEGINNING at a point in common with  lands  now  or  formerly  of  the
    13  Village  of  Montgomery,  Tax  Map  Section 201, Block 3, Lot 18.1, said
    14  point also being a point in common with lands now  or  formerly  of  the
    15  Village  of  Montgomery,  Tax  Map  Section  201, Block 3, Lot 19.2; and
    16  running thence along said Lot 18.1 N70°28'00"W 160.00 feet; thence leav-
    17  ing said Lot 18.1 and running through Lot 19.2 N00°00'00"E 220.95  feet;
    18  thence  N27°59'05"E  261.84  feet to a point in common with lands now or
    19  formerly of Riverside Cemetery, Tax Map Section 201,  Block  3,  Lot  3;
    20  thence  along  said  Lot  3  S58°50'00"E 298.62 feet; thence S31°10'00"W
    21  24.00 feet; thence S58°50'00"E  45.00  feet;  thence  N31°10'00"E  24.00
    22  feet;  thence  S60°18'00"E  186.00  feet;  thence leaving said Lot 3 and
    23  running through Lot 19.2 S30°39'00"W  372.09  feet;  thence  N70°28'00"W
    24  252.50 feet to the point or place of beginning.
    25    Containing 4.74± acres of land.
    26    Subject to any easements or agreements, if any.
    27    §  3.  The authorization, granted pursuant to section one of this act,
    28  shall be subject to a requirement that the village of  Montgomery  dedi-

     1  cate  an  amount  equal  to or greater than the fair market value of the
     2  parcel, described in section two of this act, for  capital  improvements
     3  of  existing  park and recreational facilities and/or for acquisition of
     4  additional park and recreational facilities.
     5    §  4. In the event that the village of Montgomery received any funding
     6  support or assistance from the  federal  government  for  the  purchase,
     7  maintenance or improvement of the  parklands set forth in section two of
     8  this  act,  discontinuance of such parkland authorized by the provisions
     9  of section one of this act shall not occur until the village of Montgom-
    10  ery has complied with any federal requirements pertaining to the conver-
    11  sion of such parklands, including satisfying the secretary of the  inte-
    12  rior  that  the  conversion  complies  with  all  conditions  which  the
    13  secretary of the interior deems necessary to assure the substitution  of
    14  other  lands  shall be equivalent in fair market value and usefulness to
    15  the lands  being converted.
    16    § 5. This act shall take effect immediately.
