        Introduced  by Sens. LAVALLE, AKSHAR, BORRELLO -- read twice and ordered
          printed, and when printed to be committed to the Committee  on  Higher
          Education  -- committee discharged, bill amended, ordered reprinted as
          amended and recommitted to said committee

        AN ACT to amend the education law, in relation to providing that tuition
          for the state university of New York and the city  university  of  New
          York shall not be increased for certain academic years

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Clause (ii) of subparagraph 4 of paragraph h of subdivision
     2  2 of section 355 of the education law, as amended by section 1  of  part
     3  JJJ of chapter 59 of the laws of 2017, is amended to read as follows:
     4    (ii) Commencing with the two thousand seventeen--two thousand eighteen
     5  academic  year and ending in the two thousand twenty--two thousand twen-
     6  ty-one academic year the state university of New York board of  trustees
     7  shall  be  empowered  to  increase  the  resident  undergraduate rate of
     8  tuition by not more than two hundred dollars over  the  resident  under-
     9  graduate  rate  of tuition adopted by the board of trustees in the prior
    10  academic year, provided, however, that beginning in  academic  year  two
    11  thousand twenty--two thousand twenty-one and ending in academic year two
    12  thousand  twenty-four--two  thousand  twenty-five,  the  annual  rate of
    13  tuition shall not be increased, provided further, however, that  if  the
    14  annual resident undergraduate rate of tuition would exceed five thousand
    15  dollars,  then a tuition credit for each eligible student, as determined
    16  and calculated by the New York state higher  education  services  corpo-
    17  ration  pursuant  to  section  six  hundred eighty-nine-a of this title,
    18  shall be applied toward the tuition charged for each  semester,  quarter
    19  or term of study and such cost shall be provided to the state university
    20  of  New  York  through state general fund operating support. Tuition for
    21  each semester, quarter or term of study shall not be due for any student
    22  eligible to receive such tuition credit  until  the  tuition  credit  is
    23  calculated and applied against the tuition charged for the corresponding
    24  semester, quarter or term. [Provided, further that the revenue resulting
    25  from  an  increase  in  the  rate  of tuition shall be allocated to each

     1  campus pursuant to a plan approved by the board of trustees  to  support
     2  investments  in  new  classroom  faculty,  instruction,  initiatives  to
     3  improve student success and on-time completion and a tuition credit  for
     4  each eligible student.]
     5    §  2.  Subparagraph  (ii) of paragraph (a) of subdivision 7 of section
     6  6206 to the education law, as amended by section 2 of part JJJ of  chap-
     7  ter 59 of the laws of 2017, is amended to read as follows:
     8    (ii) Commencing with the two thousand seventeen--two thousand eighteen
     9  academic  year and ending in the two thousand twenty--two thousand twen-
    10  ty-one academic year the city university of New York board  of  trustees
    11  shall  be  empowered  to  increase  the  resident  undergraduate rate of

    34    § 3. This act shall take effect immediately; provided, that:
    35    1. the amendments to clause (ii) of subparagraph 4 of paragraph  h  of
    36  subdivision 2 of section 355 of the education law made by section one of
    37  this  act shall not affect the expiration of such subparagraph and shall
    38  expire therewith; and
    39    2. the amendments to subparagraph (ii) of paragraph (a) of subdivision
    40  7 of section 6206 of the education law made by section two of  this  act
    41  shall not affect the expiration of such paragraph and shall expire ther-
    42  ewith.
