STATE OF NEW YORK ________________________________________________________________________ 7646 IN SENATE February 2, 2018 ___________ Introduced by Sen. FLANAGAN -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT to amend the public buildings law, in relation to requiring full family service restroom facilities in public buildings The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The public building law is amended by adding a new section 2 54 to read as follows: 3 § 54. Restroom accessibility and equipment requirements for public 4 buildings. 1. In addition to all of the requirements of the state build- 5 ing code referenced in section fifty-one of this article, all buildings 6 covered by this article shall be required to include, at a minimum, at 7 least one family restroom, accessible from any point within the building 8 open to the public, which is to be equipped such that a caregiver is 9 able to attend to the sanitary and hygienic needs of any person affected 10 by any combination of physical and/or cognitive disabilities such that 11 they require constant assistance with activities for daily living, 12 including, but are not strictly limited to, an inability to utilize 13 conventional restroom facilities. 14 2. The precise configuration and equipment to be included in such 15 family restroom facilities shall be determined pursuant to rules and 16 regulations promulgated by the department of state codes division, in 17 cooperation with the office for persons with developmental disabilities, 18 and with the input of an independent party, appointed by the governor, 19 who is the parent or legal guardian of a person whose disabilities 20 prevent their use of conventional restroom facilities. The equipment is 21 to include a horizontal flat raised surface area suitable for safely 22 diapering an adult person of at least two hundred fifty pounds weight 23 and equipped with a system to temporarily cover the surface with a sani- 24 tary disposable covering. All such rules and regulations shall be 25 promulgated and implemented within one hundred eighty days of the effec- 26 tive date of this section. 27 § 2. This act shall take effect immediately.
