STATE OF NEW YORK ________________________________________________________________________ 7612 2023-2024 Regular Sessions IN SENATE July 26, 2023 ___________ Introduced by Sen. KRUEGER -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the social services law, in relation to expanding Medi- caid coverage to include abortion services and travel-related expenses uncovered by the military for certain New York state residents The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 2 of section 365-a of the social services law 2 is amended by adding a new paragraph (mm) to read as follows: 3 (mm) abortion services, including surgical and pharmaceutical 4 abortions, and any necessary travel-related expenses incurred to receive 5 such services due to the recipient of such services being located within 6 another state or a foreign country where such services could not legally 7 be obtained, which are not covered by any other insurance or the armed 8 forces of the United States, when: 9 (i) such services are provided by a health care practitioner licensed, 10 certified, or authorized under title eight of the education law, acting 11 within his or her lawful scope of practice; and 12 (ii) such services are provided to a resident of the state who is an 13 active duty member of the armed forces of the United States, or who is a 14 spouse or dependent of such member. 15 § 2. This act shall take effect on the one hundred eightieth day after 16 it shall have become a law. Effective immediately, the addition, amend- 17 ment and/or repeal of any rule or regulation necessary for the implemen- 18 tation of this act on its effective date are authorized to be made and 19 completed on or before such effective date.
