FINCH -- read once and referred to the Committee on Local Governments -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said commit- tee AN ACT to amend the village law and the public officers law, in relation to waiving the residency requirement for the code enforcement officer in the village of Aurora, Cayuga county The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 3-300 of the village law is amended by adding a new 2 subdivision 26 to read as follows: 3 26. Notwithstanding the provisions of this chapter or any other gener- 4 al law, local law, ordinance, or special act, the village board of trus- 5 tees of the incorporated village of Aurora, Cayuga county, may, by 6 resolution, provide that the code enforcement officer of the village of 7 Aurora, Cayuga county, need not be a resident of such village, but must 8 be a resident of the county of Cayuga, state of New York, or of a county 9 which adjoins the county of Cayuga. 10 § 2. Section 3 of the public officers law is amended by adding a new 11 subdivision 65 to read as follows: 12 65. In the village of Aurora, in the county of Cayuga, the provisions 13 of this section requiring a person to be a resident of the political 14 subdivision or municipal corporation of the state for which he or she 15 shall be chosen or within which his or her official functions are 16 required to be exercised shall not prevent a person from holding the 17 office of code enforcement officer, provided that such person resides in 18 the county of Cayuga or an adjoining county within the state of New 19 York. Provided, however, the person performing the functions of code 20 enforcement officer in any other village shall be a resident of such 21 village, unless otherwise provided by law. 22 § 3.
