STATE OF NEW YORK ________________________________________________________________________ 6965 2021-2022 Regular Sessions IN SENATE May 20, 2021 ___________ Introduced by Sen. KENNEDY -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law, in relation to computation of certain transportation aid The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 4 of section 3623-a of the education law, as 2 added by section 22 of part A of chapter 56 of the laws of 2021, is 3 amended to read as follows: 4 4. Notwithstanding the provisions of this section or any other 5 provision of law to the contrary, for the computation of transportation 6 aid pursuant to the requirements of subdivision seven of section thir- 7 ty-six hundred two of this article, allowable transportation expenses 8 shall also include transportation operating expenses described in subdi- 9 vision one of this section and transportation capital, debt service and 10 lease expenses described in subdivision two of this section incurred in 11 the two thousand nineteen--two thousand twenty school year and the two 12 thousand twenty--two thousand twenty-one school year: (i) during the 13 state disaster emergency declared pursuant to executive order 202 of 14 2020 in the case of expenses pursuant to subdivision eight of section 15 thirty-six hundred twenty-two-a of this part; and (ii) during the [peri-16od between the issuance of executive order 202.4 on March sixteenth, two17thousand twenty and the issuance of executive order 202.28 on May18seventh, two thousand twenty] state disaster emergency declared pursuant 19 to executive order two hundred two of two thousand twenty in the case of 20 expenses pursuant to subdivision nine of section thirty-six hundred 21 twenty-two-a of this part. Such expenses shall be allowable transporta- 22 tion expenses even where aidable regular transportation as defined in 23 section thirty-six hundred twenty-two-a of this part of transportation 24 after four pm pursuant to section thirty-six hundred twenty-seven of 25 this part was not provided. 26 § 2.
