STATE OF NEW YORK ________________________________________________________________________ 6916 2023-2024 Regular Sessions IN SENATE May 15, 2023 ___________ Introduced by Sen. KENNEDY -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to requiring the issuance of stickers for alternative fuel vehicles The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The vehicle and traffic law is amended by adding a new 2 section 401-c to read as follows: 3 § 401-c. Alternative fuel stickers. 1. The commissioner shall adopt 4 rules and regulations requiring the issuance of special stickers identi- 5 fying alternative fuel vehicles. Such rules and regulations shall: 6 require that such stickers shall be affixed to the inside of a vehicle's 7 windshield and that such stickers shall be easily identifiable to first 8 responders as an alternative fuel vehicle; differentiate between 9 personal and commercial vehicles; require that applications for motor 10 vehicle registration or re-registration include information pertaining 11 to whether a vehicle is an alternative fuel vehicle; and provide that an 12 owner of an alternative fuel vehicle may request such special sticker 13 upon submission of specific information. 14 2. Starting January first next succeeding the effective date of this 15 section, the department shall issue to the owner of an alternative fuel 16 vehicle a sticker identifying such vehicle as being an alternative fuel 17 vehicle at the time of registration or re-registration of such vehicle. 18 Such sticker may also be requested by the owner of an alternative fuel 19 vehicle at other times upon the submission of such information as 20 required by the commissioner. 21 3. Stickers shall be produced in a size and form suitable for applica- 22 tion to the inside of a vehicle's windshield and shall be applied by the 23 owner of the vehicle to the windshield of the vehicle adjacent to the 24 vehicle's registration sticker in a manner so as to not obstruct or 25 interfere with the view of the vehicle operator through the windshield, EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. For the purposes of this section, "alternative fuel" means: biod- 4 iesel (B100); natural gas and liquid fuels domestically produced from 5 natural gas; propane (liquefied petroleum gas); electricity; hydrogen; 6 blends of eighty-five percent or more of methanol, denatured ethanol, 7 and other alcohols with gasoline or other fuels; methanol, denatured 8 ethanol, and other alcohols; coal-derived, domestically produced liquid 9 fuels; fuels (other than alcohol) derived from biological materials; and 10 p-series fuels. 11 § 2. This act shall take effect immediately.
