STATE OF NEW YORK ________________________________________________________________________ 6876--A 2021-2022 Regular Sessions IN SENATE May 20, 2021 ___________ Introduced by Sen. JORDAN -- read twice and ordered printed, and when printed to be committed to the Committee on Education -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT in relation to directing the commissioner of education, in consultation with the superintendent of financial services and the office of the state comptroller, to study and prepare a report concerning school insurance reserve funds; and providing for the repeal of such provisions upon expiration thereof The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The commissioner of education, in consultation with the 2 superintendent of financial services and the office of the state comp- 3 troller, or the designees of such persons, shall review and report on 4 the adequacy, reasonableness and affordability of school insurance 5 reserve funds as they relate to the provision of health care benefits to 6 covered employees and prepare and deliver a report containing the find- 7 ings of the study. Such report shall include but not be limited to an 8 analysis of the following: 9 (a) the typical annual costs of providing health insurance through 10 self-insurance by a school district and the impact that such self-insu- 11 rance has on the annual budget of a school district, including the over- 12 all immediate and long-term costs; 13 (b) the costs to the employees in school districts of providing health 14 insurance through self-insurance by the school district; 15 (c) whether providing health insurance through self-insurance by a 16 school district using school insurance reserve funds has increased 17 access for covered school employees to health care or has made the proc- 18 ess of getting reimbursed or getting coverage easier or more difficult; 19 and EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD11586-02-1S. 6876--A 2 1 (d) the amount of funding participating self-insured school districts 2 have set aside in their reserve funds. 3 § 2. Within one year of the effective date of this act, the commis- 4 sioner of education shall submit the report to the governor, the tempo- 5 rary president of the senate, the speaker of the assembly and the minor- 6 ity leaders of the senate and the assembly. 7 § 3. This act shall take effect immediately and shall expire and be 8 deemed repealed 60 days after the submission of the report pursuant to 9 section two of this act.
