        Introduced  by Sen. STAVISKY -- read twice and ordered printed, and when
          printed to be committed to the Committee on Higher Education
        AN ACT to amend the education law, in relation  to  authorizing  pharma-
          cists to dispense certain contraceptives
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. The education law is amended by adding a new  section  6832
     2  to read as follows:
     3    §  6832. Dispensing contraception. 1. In accordance with rules adopted
     4  by the state board  of  pharmacy  a  pharmacist  may  dispense  hormonal
     5  contraceptive  patches  and  self-administered  oral hormonal contracep-
     6  tives.
     7    2. The board shall adopt rules to establish in consideration of guide-
     8  lines established by the American Congress of Obstetricians and Gynecol-
     9  ogists, standard procedures for the prescribing of  hormonal  contracep-
    10  tive  patches  and  self-administered  oral  hormonal  contraceptives by
    11  pharmacists.
    12    3. The rules adopted under this section must require a pharmacist to:
    13    a. complete a training program approved by the state board of pharmacy
    14  that is related to prescribing hormonal contraceptive patches and  self-
    15  administered oral hormonal contraceptives;
    16    b. provide a self-screening risk assessment tool that the patient must
    17  use  prior  to  the  pharmacist's prescribing the hormonal contraceptive
    18  patch or self-administered oral hormonal contraceptive;
    19    c. refer the patient to the patient's  primary  care  practitioner  or
    20  women's  health  care  practitioner  upon prescribing and dispensing the
    21  hormonal contraceptive patch or self-administered oral hormonal  contra-
    22  ceptive;
    23    d.  provide  the patient with a written record of the hormonal contra-
    24  ceptive  patch  or   self-administered   oral   hormonal   contraceptive
    25  prescribed and dispensed and advise the patient to consult with a prima-
    26  ry care practitioner or women's health care practitioner; and
