BONACIC -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government -- reported favorably from said committee and committed to the Committee on Finance -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the general municipal law, in relation to the definition of consolidation for the consolidation in dissolution of local govern- ment THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Subdivision 2 of section 750 of the general municipal law, 2 as added by chapter 74 of the laws of 2009, is amended to read as 3 follows: 4 2. "Consolidation" shall mean [either] (a) the combination of two or 5 more local government entities resulting in the termination of the 6 existence of each of the entities to be consolidated and the creation of 7 a new entity which assumes jurisdiction over all of the terminated enti- 8 ties[, or]; (b) the combination of two or more local government entities 9 resulting in the termination of the existence of all but one of the 10 entities which shall absorb the terminated entity or entities; OR (C) 11 THE ALTERATION OF THE BORDERS OF A VILLAGE TO BE COTERMINOUS WITH A TOWN 12 WHEN THE IMPLEMENTATION OF SUCH CONTERMINOUS BORDERS CAN BE DEMONSTRATED 13 BY THE TOWN AND VILLAGE TO THE SATISFACTION OF THE SECRETARY OF STATE 14 THAT A CONSOLIDATION OF SERVICES SHALL OCCUR PRODUCING A NET SAVINGS TO 15 PROPERTY TAXPAYERS. 16 S 2.
