STATE OF NEW YORK ________________________________________________________________________ 6752 2019-2020 Regular Sessions IN SENATE September 25, 2019 ___________ Introduced by Sen. LITTLE -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the mental hygiene law, in relation to authorizing the office of mental health and the office for people with developmental disabilities to provide transitional care for certain persons The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraph 6 of subdivision (a) of section 7.37-a of the 2 mental hygiene law is renumbered paragraph 7. 3 § 2. Paragraph 5 of subdivision (a) of section 7.37-a of the mental 4 hygiene law, as added by chapter 405 of the laws of 1998, is amended and 5 a new paragraph 6 is added to read as follows: 6 5. whose residential needs can be met by the facility in which the 7 persons resided prior to becoming age twenty-one or becoming ineligible 8 for free educational services; [and] 9 6. who were disabled and in need of residential educational placement 10 prior to becoming twenty-one years of age, provided that such person was 11 abandoned and that such transitional care shall only be provided until 12 residential educational placement is found for such person; and 13 § 3. Paragraph 6 of subdivision (a) of section 13.37-a of the mental 14 hygiene law is renumbered paragraph 7. 15 § 4. Paragraph 5 of subdivision (a) of section 13.37-a of the mental 16 hygiene law, as amended by chapter 106 of the laws of 2015, is amended 17 and a new paragraph 6 is added to read as follows: 18 5. whose residential needs can be met by the facility in which the 19 persons resided prior to becoming age twenty-one or becoming ineligible 20 for free educational services; [and] 21 6. who were disabled and in need of residential educational placement 22 prior to becoming twenty-one years of age, provided that such person was 23 abandoned and that such transitional care shall only be provided until 24 residential educational placement is found for such persons; and 25 § 5.
