GOLDEN -- read twice and ordered printed, and when printed to be committed to the Committee on Cultural Affairs, Tourism, Parks and Recreation -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the arts and cultural affairs law, in relation to child performers in community theater The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 2 of section 35.01 of the arts and cultural 2 affairs law, as amended by chapter 35 of the laws of 2004, is amended to 3 read as follows: 4 2. The provisions of subdivision one of this section shall not apply 5 to the participation or employment, use or exhibition of any child in a 6 church, academy or school, including a dancing or dramatic school, as 7 part of the regular services or activities thereof respectively; or in 8 the annual graduation exercises of any such academy or school; or in a 9 private home; or in any place where such performance is under the direc- 10 tion, control or supervision of a department of education; or in the 11 performance of radio or television programs in cases where the child or 12 children broadcasting do so from a school, church, academy, museum, 13 library or other religious, civic or educational institution, or for not 14 more than two hours a week from the studios of a regularly licensed 15 broadcasting company, where the performance of the child or children is 16 of a nonprofessional character and occurs during hours when attendance 17 for instruction is not required in accordance with the education law; or 18 at a not-for-profit community theater where the performance of the child 19 or children occurs during hours when attendance for instruction is not 20 required in accordance with the education law, where none of the partic- 21 ipants are members of any performing arts labor organization, and that 22 all performers, not only children, must participate as amateur volun- 23 teers. 24 § 2.
