STATE OF NEW YORK ________________________________________________________________________ 6635 2023-2024 Regular Sessions IN SENATE May 2, 2023 ___________ Introduced by Sen. RAMOS -- read twice and ordered printed, and when printed to be committed to the Committee on Labor AN ACT to amend the workers' compensation law, in relation to claims for mental injury premised upon extraordinary work-related stress The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraph (b) of subdivision 3 of section 10 of the work- 2 ers' compensation law, as added by section 1 of subpart I of part NNN of 3 chapter 59 of the laws of 2017, is amended to read as follows: 4 (b) Where a [police officer or firefighter subject to section thirty5of this article, or emergency medical technician, paramedic, or other6person certified to provide medical care in emergencies, or emergency7dispatcher] worker files a claim for mental injury premised upon 8 extraordinary work-related stress incurred [in a work-related emergency] 9 at work, the board may not disallow the claim[,] upon a factual finding 10 that the stress was not greater than that which usually occurs in the 11 normal work environment. 12 § 2. This act shall take effect on the first of January next succeed- 13 ing the date on which it shall have become a law.
