STATE OF NEW YORK ________________________________________________________________________ 6625 2017-2018 Regular Sessions IN SENATE June 7, 2017 ___________ Introduced by Sen. KENNEDY -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend chapter 674 of the laws of 2007, amending the environ- mental conservation law, relating to creating the New York invasive species council, in relation to establishing a pilot grant program in Erie county to explore the effectiveness of tree removal in combatting the spread of emerald ash borer The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Chapter 674 of the laws of 2007, amending the environmental 2 conservation law, relating to creating the New York invasive species 3 council, is amended by adding a new section 1-a to read as follows: 4 § 1-a. 1. The New York invasive species council, as defined in section 5 9-1705 of the environmental conservation law, shall administer a pilot 6 grant program in Erie county, in an amount not to exceed $250,000, to 7 explore the effectiveness of tree removal in combatting the spread of 8 emerald ash borer. Pilot program grants will be provided to the county 9 for the reimbursement of reasonable costs incurred by low-income home- 10 owners, in an amount not to exceed $250 per tree, and a maximum of 11 $1,000 per property, for the removal of trees killed or infected by 12 emerald ash borers, in a manner determined by the New York invasive 13 species council to minimize the risk of further emerald ash borer 14 contamination. Grants may only be provided in cases where such dead or 15 infected trees represent an imminent danger. 16 2. No later than March 1, 2020, the New York invasive species council 17 shall issue a report to the legislature detailing the results of the 18 pilot grant program. 19 § 2.
