STATE OF NEW YORK ________________________________________________________________________ 6463 2017-2018 Regular Sessions IN SENATE May 23, 2017 ___________ Introduced by Sen. ADDABBO -- read twice and ordered printed, and when printed to be committed to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to establishing an implementation and effectiveness task force to study compliance with electronic equipment recycling and reuse requirements The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The environmental conservation law is amended by adding a 2 new section 27-2622 to read as follows: 3 § 27-2622. Implementation and effectiveness task force. 4 1. Not less than ninety days after the effective date of this section, 5 the commissioner shall convene a task force to study the implementation 6 and effectiveness of this title. The task force shall study issues 7 including but not limited to: 8 (a) the amount of electronic waste recycled in the state and propensi- 9 ty of consumer electronic waste items to be properly recycled or reused 10 as required under this title; 11 (b) the compliance with this title of both consumers and manufacturers 12 in recycling and reusing consumer-generated waste; 13 (c) the ways in which municipalities have adapted waste service to 14 allow for electronic waste recycling in furtherance of this title, 15 including whether municipalities have included or excluded curbside 16 electronic waste collection as a result of the enactment of this 17 section; and 18 (d) whether additional legislation is needed to more fully ensure 19 compliance and effective implementation of this title. 20 2. The task force shall complete a report no later than one year after 21 the effective date of this section announcing its findings and recommen- 22 dations pursuant to subdivision one of this section and the commissioner 23 shall transmit such report to the temporary president of the senate, 24 speaker of the assembly, minority leader of the senate, minority leader EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. The commissioner may reconvene the task force provided under this 4 section as he or she deems fit on a date no less than one year after the 5 report required in subdivision two of this section is completed. If such 6 task force shall be called by the commissioner, the provisions of subdi- 7 visions one and two of this section shall apply except that the report 8 shall be completed and transmitted no later than one year after the date 9 the commissioner reconvenes such task force. 10 § 2. This act shall take effect immediately.
