PARKER, BIAGGI, MONTGOMERY, MYRIE -- read twice and ordered printed, and when printed to be committed to the Committee on Rules -- recommitted to the Committee on Environmental Conservation in accordance with Senate Rule 6, sec. 8 -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said commit- tee AN ACT to amend the environmental conservation law, in relation to the definition of eligible vehicles for climate smart community projects The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subparagraph (i) of paragraph c of subdivision 1 of section 2 54-1521 of the environmental conservation law, as added by section 5 of 3 part U of chapter 58 of the laws of 2016, is amended to read as follows: 4 (i) has up to four wheels; 5 § 2. Paragraph b of subdivision 3 of section 54-1521 of the environ- 6 mental conservation law, as added by section 5 of part U of chapter 58 7 of the laws of 2016, is amended to read as follows 8 b. The department, in consultation with the New York state energy 9 research and development authority, shall determine the amount of the 10 rebate taking into consideration the electric range of the vehicle and 11 the estimated annual greenhouse gas emissions reductions provided by 12 that vehicle as compared to a similar internal combustion engine 13 vehicle, provided that a rebate of an eligible purchase shall be not 14 [less than seven hundred fifty dollars per vehicle and not] more than 15 five thousand dollars per vehicle. 16 § 3.
