          printed to be committed  to  the  Committee  on  Local  Government  --

          recommitted to said committee

        AN ACT to amend chapter 719 of the laws of 1982, relating to authorizing
          the commissioner of general services to convey certain state lands  in
          the  county of Suffolk to the town of Islip, in relation to exceptions
          for certain property

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  Chapter  719 of the laws of 1982, relating to authorizing
     2  the commissioner of general services to convey certain  state  lands  in
     3  the  county  of Suffolk to the town of Islip, is amended by adding a new
     4  section 1-b to read as follows:
     5    § 1-b. The commissioner of general services shall amend  a  conveyance
     6  to the town of Islip to remove restrictions provided in section seven of
     7  this  act applying to the parcel of land described in section eight-b of
     8  this act. Such amended conveyance shall be conditioned upon  payment  to
     9  the  state  of  New  York  by  the  town of Islip of fair and reasonable
    10  consideration as determined by the commissioner of general services.
    11    § 2. The opening paragraph of section 7 of chapter 719 of the laws  of
    12  1982,  relating  to  authorizing the commissioner of general services to
    13  convey certain state lands in the county  of  Suffolk  to  the  town  of
    14  Islip,  as  amended by chapter 395 of the laws of 2016, is amended and a
    15  new section 8-b is added to read as follows:
    16    With the exception of the [land] lands described in [section] sections
    17  seven-a and eight-b of this  act,  any  land  and  improvements  thereon
    18  transferred  pursuant  to  this  act  shall  be used only by, or for the
    19  purposes of the state, the United States of America and its  transferees
    20  or  assigns,  a  union  free school district as defined by the education
    21  law, a municipal corporation or a not-for-profit college  or  university

     1  chartered  by  the  regents  of the university of the state of New York.
     2  Except for the United States of America and its transferees or  assigns,
     3  said  land and any improvements thereon shall be used only for hospital,
     4  park  and  recreation, municipal office or educational purposes, and for
     5  complementary  academic,  scientific  or  technological  uses,   applied
     6  research  and  developmental  activities  of a not-for-profit college or
     7  university, a voluntary, municipal or state-operated hospital,  a  union
     8  free  school  district  as  defined  by the education law or a municipal
     9  corporation. Said land or any improvements thereon transferred  pursuant
    10  to  this  act  to  the  United  States  of America or its transferees or
    11  assigns shall not be designed  or  altered  for  the  overnight  housing
    12  and/or   custody  of  prisoners  or  detainees.  These  purposes  and/or
    13  restrictions shall  be  recorded  as  deed  covenants  and  restrictions
    14  running  with  the  land  upon  the  transfer of the land to the town of
    15  Islip, Suffolk county and its transferees or assigns.  Provided,  howev-
    16  er,  that  the commissioner of general services, subject to the approval
    17  of the town of Islip as evidenced by a resolution of the town board  and
    18  upon  payment of fair and reasonable consideration as determined by said
    19  commissioner by New York Institute of Technology to the office of gener-
    20  al services, shall amend, modify or delete as set forth in  said  resol-
    21  ution  any  of the above stated purposes, including the requirement that
    22  they be recorded as deed covenants and  restrictions  running  with  the
    23  land as such purposes and restrictions may appear in a conveyance to the
    24  town  of  Islip,  its  transferee and assigns and apply to the following
    25  described five parcels of land:
    26    § 8-b. The lands subject to the amended conveyance pursuant to section
    27  one-b of this act are situated in the town of Islip, Suffolk county, and
    28  are generally described as follows:
    29    All that certain plot, piece or parcel of land with the buildings  and
    30  improvements thereon erected, situate, lying and being in Central Islip,
    31  in  the  Town  of  Islip, County of Suffolk and State of New York, being
    32  more particularly bounded and described as follows:
    33    BEGINNING at a point on the easterly side of Carleton Avenue,  distant
    34  1,867.92  feet--deed  (1865.05  feet--survey)  southerly from the corner
    35  formed by the intersection of the easterly side of Carleton  Avenue  and
    36  the  southerly  side of Smith street; RUNNING THENCE North 82 degrees 18
    37  minutes 29 seconds East, 321.03 feet-deed (319.77 feet--survey);  THENCE
    38  South  07  degrees 28 minutes 58 seconds East, 300.00 feet; THENCE South
    39  82 degrees 18 minutes 29 seconds West, 319.94 feet--deed (318.49  feet--
    40  survey),  to  the  easterly  side  of  Carleton  Avenue; THENCE North 07
    41  degrees 41 minutes 31 seconds West--deed (North 07  degrees  43  minutes
    42  seconds  West--survey),  along  the  easterly  side  of Carleton Avenue,
    43  300.00 feet to the point or place of BEGINNING.
    44    § 3. This act shall take effect immediately.
