GOLDEN -- read twice and ordered printed, and when printed to be committed to the Committee on Health -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the public health law, in relation to requiring golf course operators to make available at least one functional cardiac defibrillator and requiring that employees of such facilities be trained in its proper operation and use THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. The public health law is amended by adding a new section 2 3000-e to read as follows: 3 S 3000-E. FUNCTIONAL CARDIAC DEFIBRILLATOR AT GOLF COURSE. 1. FOR THE 4 PURPOSES OF THIS SECTION, THE FOLLOWING TERMS SHALL BE DEFINED AS 5 FOLLOWS: 6 A. "GOLF COURSE" MEANS AN AREA OF LAND LAID OUT FOR GOLF WITH A SERIES 7 OF NINE OR EIGHTEEN HOLES EACH INCLUDING TEE, FAIRWAY, AND PUTTING 8 GREEN. 9 B. "GOLF COURSE OPERATOR" MEANS ANY PERSON, FIRM, CORPORATION, PART- 10 NERSHIP, UNINCORPORATED ASSOCIATION OR OTHER ENTITY, WHETHER PUBLICLY OR 11 PRIVATELY OWNED OR OPERATED, THAT MANAGES ANY GOLF COURSE. 12 2. GOLF COURSE OPERATORS SHALL PROVIDE AND MAINTAIN ON-SITE AUTOMATED 13 EXTERNAL DEFIBRILLATORS (AED), AS DEFINED IN PARAGRAPH (A) OF SUBDIVI- 14 SION ONE OF SECTION THREE THOUSAND-B OF THIS ARTICLE, IN QUANTITIES AND 15 TYPES DEEMED BY THE COMMISSIONER TO BE ADEQUATE TO ENSURE READY AND 16 APPROPRIATE ACCESS FOR USE DURING EMERGENCIES. 17 3. EVERY GOLF COURSE OPERATOR SHALL HAVE IN ATTENDANCE, AT ALL TIMES 18 DURING STAFFED BUSINESS HOURS, AT LEAST ONE INDIVIDUAL PERFORMING 19 EMPLOYMENT OR INDIVIDUAL ACTING AS AN AUTHORIZED VOLUNTEER WHO IS 20 TRAINED, PURSUANT TO PARAGRAPH (A) OF SUBDIVISION THREE OF SECTION THREE 21 THOUSAND-B OF THIS ARTICLE, IN THE OPERATION AND USE OF AN AED. 22 4. GOLF COURSE OPERATORS SHALL BE SUBJECT TO THE REQUIREMENTS AND 23 LIMITATIONS OF SECTION THREE THOUSAND-B OF THIS ARTICLE. ANY GOLF COURSE OPERATOR, HIS OR HER EMPLOYEE OR OTHER AGENT, OR 2 ANY PERSON WHO VOLUNTARILY AND WITHOUT EXPECTATION OF MONETARY COMPEN- 3 SATION RENDERS EMERGENCY TREATMENT USING SUCH DEFIBRILLATOR PURSUANT TO 4 THIS SECTION, TO A PERSON WHO IS UNCONSCIOUS, ILL OR INJURED, SHALL ONLY 5 BE LIABLE PURSUANT TO SECTION THREE THOUSAND-A OF THIS ARTICLE. 6 S 2. This act shall take effect on the one hundred twentieth day after 7 it shall have become a law, provided, however, that effective immediate- 8 ly, the addition, amendment and/or repeal of any rules or regulations 9 necessary for the implementation of this act on its effective date are 10 authorized and directed to be made and completed on or before such 11 effective date.
