STATE OF NEW YORK ________________________________________________________________________ 6055 2021-2022 Regular Sessions IN SENATE April 1, 2021 ___________ Introduced by Sen. SKOUFIS -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend the general municipal law, in relation to allowing industrial development agencies to make grants to municipalities for open space preservation, parkland improvements and conservation ease- ments The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivisions 18 and 19 of section 858 of the general munic- 2 ipal law, subdivision 18 as added and subdivision 19 as amended by chap- 3 ter 109 of the laws of 2020, are amended to read as follows: 4 (18) To provide grants to small businesses and not-for-profit corpo- 5 rations, as defined in section eight hundred fifty-nine-c of this title, 6 for the purpose of acquiring personal protective equipment or installing 7 fixtures necessary to prevent the spread of novel coronavirus, COVID-19, 8 during the period in which executive order two hundred two of two thou- 9 sand twenty, as amended, is in effect. In order to be eligible for a 10 grant pursuant to this subdivision, a small business or not-for-profit 11 corporation must meet the requirements of paragraph a of subdivision 12 three of section eight hundred fifty-nine-c of this title. No industrial 13 development agency may provide a small business or not-for-profit corpo- 14 ration with more than ten thousand dollars pursuant to this subdivision; 15 [and] 16 (19) To make grants to the municipality for whose benefit the agency 17 was established for the purpose of open space preservation, parkland 18 improvements and conservation easements provided the governing board of 19 such municipality shall accept the same and find that the same encour- 20 ages tourism or otherwise improves the quality of life in such munici- 21 pality; and 22 (20) To do all things necessary or convenient to carry out its 23 purposes and exercise the powers expressly given in this title. EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD10676-02-1S. 6055 2 1 § 2. Subdivisions 16 and 17 of section 858 of the general municipal 2 law, as added by chapter 1030 of the laws of 1969 and as renumbered by 3 chapter 356 of the laws of 1993, are amended to read as follows: 4 (16) To establish and re-establish its fiscal year; [and] 5 (17) To make grants to the municipality for whose benefit the agency 6 was established for the purpose of open space preservation, parkland 7 improvements and conservation easements provided the governing board of 8 such municipality shall accept the same and find that the same encour- 9 ages tourism or otherwise improves the quality of life in such munici- 10 pality; and 11 (18) To do all things necessary or convenient to carry out its 12 purposes and exercise the powers expressly given in this title. 13 § 3. This act shall take effect immediately; provided however that the 14 amendments to subdivisions 18 and 19 of section 858 of the general 15 municipal law made by section one of this act shall be subject to the 16 expiration and reversion of such subdivisions pursuant to section 3 of 17 chapter 109 of the laws of 2020, as amended, when upon such date the 18 provisions of section two of this act shall take effect.
