       Introduced  by  Sens.  SAMPSON, DIAZ, HASSELL-THOMPSON, KRUEGER, MONSER-
         RATE, OPPENHEIMER, SAVINO -- read twice and ordered printed, and  when
         printed to be committed to the Committee on Rules
       AN ACT to amend the labor law, in relation to prohibiting certain retal-
         iatory personnel action by employers
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Paragraph (a) of subdivision 2 of section 740 of the  labor
    2  law, as amended by chapter 442 of the laws of 2006, is amended and a new
    3  paragraph (a-1) is added to read as follows:
    4    (a) discloses, or threatens to disclose to a supervisor or to a public
    5  body  an  activity,  policy  or  practice  of  the  employer  that is in
    6  violation of [law,] rule  or  regulation  which  violation  creates  and
    7  presents a substantial and specific danger to the public health or safe-
    8  ty, or which constitutes health care fraud;
    9    (A-1)  DISCLOSES,  OR  THREATENS  TO  DISCLOSE TO A SUPERVISOR OR TO A
   10  PUBLIC BODY AN ACTIVITY, POLICY OR PRACTICE OF THE EMPLOYER THAT  IS  IN
   11  VIOLATION OF LAW;
   12    S 2. This act shall take effect immediately.
