        AN ACT to amend the agriculture and markets law, in relation to agricul-
          tural assessment eligibility for beekeeping land

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section 1. Paragraph k of subdivision 4 of section 301 of the agricul-
     2  ture  and  markets  law, as added by chapter 341 of the laws of 2008, is
     3  amended to read as follows:
     4    k. Land used to support an apiary products operation which is owned by
     5  the operation and consists of [(i)] not less than  [seven]  three  acres
     6  nor  more  than  [ten]  twenty  acres  used as a single operation in the
     7  preceding two years for the production for sale of crops,  livestock  or
     8  livestock  products  of  an  average  gross  sales value of ten thousand
     9  dollars or more [or (ii) less than seven acres used as a  single  opera-
    10  tion  in  the  preceding two years for the production for sale of crops,
    11  livestock or livestock products of an average gross sales value of fifty
    12  thousand dollars or more] with a minimum of ten  honeybee  colonies  per
    13  acre  of land and any appropriate pollinator plants, or other additional
    14  municipal code requirements. The land used to support an apiary products
    15  operation shall include, but not be limited to, the land under a  struc-
    16  ture within which apiary products are produced, harvested and stored for
    17  sale;  and  a buffer area maintained by the operation between the opera-
    18  tion and adjacent landowners.   Notwithstanding any other  provision  of
    19  this  subdivision, rented land associated with an apiary products opera-
    20  tion is not eligible for an agricultural assessment based on this  para-
    21  graph.
    22    § 2. This act shall take effect immediately.
