STATE OF NEW YORK ________________________________________________________________________ 5377 2017-2018 Regular Sessions IN SENATE March 23, 2017 ___________ Introduced by Sen. BONACIC -- (at request of the New York State Gaming Commission) -- read twice and ordered printed, and when printed to be committed to the Committee on Racing, Gaming and Wagering AN ACT to amend the racing, pari-mutuel wagering and breeding law, in relation to the operation of commercial casinos The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 1 of section 1339 of the racing, pari-mutuel 2 wagering and breeding law, as added by chapter 174 of the laws of 2013, 3 is amended to read as follows: 4 1. [Except as otherwise provided in this section, no] No gaming facil- 5 ity licensee or any person licensed under this article, and no person 6 acting on behalf of or under any arrangement with a gaming facility 7 licensee or other person licensed under this article, shall: 8 (a) [Cash] cash any check[, make any loan, or otherwise provide or9allow to any person any credit or advance of anything of value or which10represents value] to enable any person to take part in gaming activity 11 as a player, other than as permitted by subdivisions two through eight 12 of this section; [or] 13 (b) [Release] make any loan, or otherwise provide or allow to any 14 person any credit or advance of anything of value, or that represents 15 value to enable any person to take part in gaming activity as a player, 16 other than as permitted by paragraph (a) of this subdivision, unless 17 done pursuant to the rules of the commission; or 18 (c) release or discharge any debt, either in whole or in part, or make 19 any loan [which] that represents any losses incurred by any player in 20 gaming activity, [without maintaining] unless a written record [thereof21in accordance with] of the transaction or activity is maintained pursu- 22 ant to the rules of the commission. 23 § 2.
