McDONALD -- read once and referred to the Committee on Cities AN ACT authorizing the city of Troy to sell or lease waterfront real property referred to as the Scolite Site THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Notwithstanding any inconsistent provision of section 20 of 2 the general city law, the city of Troy, acting by and through its city 3 council, is authorized to sell or lease the waterfront real property 4 known as the Scolite Site as described in section three of this act. 5 S 2. The authorization contained in section one of this act shall take 6 effect only upon the condition that the city of Troy dedicate an amount 7 equal to or greater than the fair market value of the property being 8 sold or leased in section three of this act toward acquisition of addi- 9 tional waterfront property and/or capital improvements to existing 10 waterfront property. 11 S 3. The parcel of land authorized to be sold or leased by section one 12 of this act is more fully described as follows: 13 ALL THAT CERTAIN TRACT PIECE OR PARCEL OF LAND situate in the city of 14 Troy, Rensselaer County, New York lying along the northerly margin of 15 Madison Street, and along the easterly Pierhead-Bulkhead line of the 16 Hudson River, being more particularly bounded and described as follows: 17 BEGINNING at a point on the northerly margin of Madison Street, at a 18 point where said northerly road margin is intersected by the division 19 line between the lands of the city of Troy, on the west, as conveyed by 20 deed July 13, 2001, as filed in the Rensselaer County Clerk's Office in 21 liber 267, page 1207 and the lands now or formerly of Troy Slag Products EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD05435-02-5 S. 5222 2 A. 7390 1 Company, Inc. on the east, as conveyed by deed dated September 30, 1996, 2 as filed in the Rensselaer County Clerk's Office in liber 44, page 580 3 and runs thence from said point of beginning, along said northerly line 4 of Madison Street and its westerly extension, North 80 degrees 58 5 minutes 00 seconds West, 529.87 feet to a point on the 1934 Pierhead- 6 Bulkhead line of the Hudson River; thence along said Pierhead-Bulkhead 7 line, North 14 degrees 25 minutes 17 seconds East, 433.94 feet to a 8 point; thence South 80 degrees 58 minutes 00 seconds East, 68.28 feet to 9 the northeast corner of parcel 2, as said parcel is set forth in deed 10 dated March 27, 1978, as filed in the Rensselaer County Clerk's Office 11 in liber 1301, page 182; thence along the westerly line of parcel 1 as 12 set forth in said deed 1301, page 182, North 06 degrees 41 minutes 17 13 seconds East, 68.03 feet to a point in the approximate centerline of the 14 Postenkill Creek; thence along the division line between the said lands 15 of the city of Troy on the south and the lands now or formerly of Troy 16 Slag Products Company, Inc. on the north, said division line being the 17 centerline of the Postenkill Creek, as set forth in said deed 44, page 18 580, South 80 degrees 58 minutes 00 seconds East, 423.63 feet to the 19 northeast corner of the lands of the city of Troy; thence continuing 20 along the division line between the said lands of the city of Troy on 21 the west and the said lands of Troy Slag Products Company, Inc. on the 22 east, South 09 degrees 02 minutes 00 seconds West, 500.00 feet to a 23 point on the northerly margin of Madison Street and the point or place 24 of beginning, being a parcel containing approximately 5.712 acres 25 includes portions of lands under water. 26 S 4. This act shall take effect immediately.
