HOYLMAN -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the civil rights law, in relation to diaper changing accommodations in certain buildings THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. The civil rights law is amended by adding a new section 2 79-o to read as follows: 3 S 79-O. DIAPER CHANGING ACCOMMODATIONS. 1. ANY PUBLIC BUILDING OR 4 PLACE OF PUBLIC ACCOMMODATION, RESORT OR AMUSEMENT, AS DEFINED IN 5 SECTION TWO HUNDRED NINETY-TWO OF THE EXECUTIVE LAW, THAT INSTALLS A 6 BABY DIAPER CHANGING ACCOMMODATION IN A RESTROOM SHALL ENSURE THAT THE 7 ACCOMMODATION IS EQUALLY AVAILABLE OR PROVIDED REGARDLESS OF THE GENDER 8 FOR WHICH THE RESTROOM IS DESIGNED. 9 2. THE PROVISIONS OF SUBDIVISION ONE OF THIS SECTION SHALL APPLY: 10 (A) TO RESTROOMS CONSTRUCTED ON OR AFTER THE EFFECTIVE DATE OF THIS 11 SECTION; 12 (B) TO RESTROOMS EXISTING ON OR AFTER THE EFFECTIVE DATE OF THIS 13 SECTION WHICH UNDERGO SUBSTANTIAL RENOVATION; AND 14 (C) TO THE EXTENT THAT THE PROVISIONS OF SUBDIVISION ONE OF THIS 15 SECTION MAY BE IMPLEMENTED IN COMPLIANCE WITH LOCAL, STATE, AND FEDERAL 16 LAWS REGARDING ACCESS FOR PERSONS WITH DISABILITIES AND WITH EXISTING 17 FIRE, HEALTH, AND SAFETY STANDARDS. 18 3. AS USED IN THIS SECTION, "SUBSTANTIAL RENOVATION" MEANS A 19 CONSTRUCTION OR RENOVATION PROJECT REQUIRING A BUILDING PERMIT WITH AN 20 ESTIMATED COST OF TEN THOUSAND DOLLARS OR MORE. 21 S 2.
