       Introduced  by  Sen. MARTINS -- read twice and ordered printed, and when
         printed to be committed to the Committee on Transportation --  commit-
         tee  discharged, bill amended, ordered reprinted as amended and recom-
         mitted to said committee
       AN ACT to amend the vehicle and traffic law, in relation to  the  opera-
         tion of a motor vehicle without a license; and to repeal subdivision 1
         of  section 509 of such law relating to the operation of a motor vehi-
         cle without a license
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1. Paragraph (a) of subdivision 1 of section 511 of the vehi-
    2  cle and traffic law, as amended by chapter 173 of the laws of  1990,  is
    3  amended to read as follows:
    4    (a)  A person is guilty of the offense of aggravated unlicensed opera-
    5  tion of a motor vehicle in the third degree when such person operates  a
    6  motor  vehicle  upon a public highway OF THIS STATE OR UPON ANY SIDEWALK
    7  OR TO OR FROM ANY LOT ADJACENT TO A PUBLIC GARAGE, SUPERMARKET, SHOPPING
    8  CENTER OR CAR WASHING ESTABLISHMENT OR TO  OR  FROM  OR  INTO  A  PUBLIC
    9  GARAGE  OR  CAR  WASHING  ESTABLISHMENT  (I) WITHOUT BEING DULY LICENSED
   10  PURSUANT TO THE PROVISIONS OF THIS CHAPTER,  EXCEPT  WHILE  OPERATING  A
   11  MOTOR VEHICLE DURING THE COURSE OF A ROAD TEST CONDUCTED PURSUANT TO THE
   12  PROVISIONS  OF  THIS  ARTICLE, OR (II) while knowing or having reason to
   13  know that such person's license or privilege  of  operating  such  motor
   14  vehicle  in  this  state  or privilege of obtaining a license to operate
   15  such motor vehicle issued by the commissioner is suspended,  revoked  or
   16  otherwise withdrawn by the commissioner.
   17    S  2.  Subdivision  1 of section 509 of the vehicle and traffic law is
   18  REPEALED.
   19    S 3. This act shall take effect on the sixtieth  day  after  it  shall
   20  have become a law.
