         PERKINS,  TKACZYK  -- read twice and ordered printed, and when printed
         to be committed to the Committee on Education -- committee discharged,
         bill amended, ordered reprinted as amended  and  recommitted  to  said
         committee  --  recommitted to the Committee on Education in accordance
         with Senate Rule 6, sec. 8  --  committee  discharged,  bill  amended,

       AN  ACT  to amend the education law, in relation to standardized testing
         for kindergarten, grade one or grade two
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 305 of the education law is amended by adding a new
    2  subdivision 44 to read as follows:
    3    44.  NOTWITHSTANDING  ANY  OTHER PROVISION OF LAW OR REGULATION TO THE
    4  CONTRARY, THE COMMISSIONER SHALL PROHIBIT THE  ADMINISTRATION  OF  STATE
    5  DEVELOPED   ASSESSMENT  OR  OTHER  COMPARABLE  ASSESSMENTS  TO  STUDENTS
    6  ENROLLED IN KINDERGARTEN, GRADE ONE OR GRADE TWO THAT ARE BEING USED FOR
    7  ANYTHING  OTHER  THAN  DIAGNOSTIC  PURPOSES.  PROVIDED  FURTHER,  SCHOOL
    8  DISTRICTS  ANNUAL PROFESSIONAL PERFORMANCE REVIEW PLANS SHALL USE ONE OF
    9  THE FOLLOWING OPTIONS TO COMPLY WITH PARAGRAPH F OF SUBDIVISION  TWO  OF
   10  SECTION THREE THOUSAND TWELVE-C OF THIS CHAPTER FOR TEACHERS OF STUDENTS
   11  ENROLLED IN KINDERGARTEN, GRADE ONE OR GRADE TWO: DISTRICT, REGIONAL, OR
   12  BOCES  DEVELOPED  ASSESSMENTS;  SCHOOL  WIDE  MEASURE  OF EITHER STUDENT
   13  GROWTH OR ACHIEVEMENT; OR A STRUCTURED DISTRICT WIDE STUDENT GROWTH GOAL
   14  SETTING PROCESS.   THE  COMMISSIONER  SHALL  PROMULGATE  REGULATIONS  TO
   15  IMPLEMENT THE PROVISIONS OF THIS SUBDIVISION.
   16    S 2. This act shall take effect July 1, 2014.
