RITCHIE -- read twice and ordered printed, and when printed to be committed to the Committee on Health -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the public health law, in relation to including certain doses of pseudoephedrine as a controlled substance THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Subdivision (d) of schedule II of section 3306 of the 2 public health law, is amended by adding a new paragraph 6 to read as 3 follows: 4 (6) 120 MILLIGRAMS OR MORE OF PSEUDOEPHEDRINE. 5 S 2. The provisions of paragraph 6 of subdivision (d) of schedule II 6 of section 3306 of the public health law shall not apply to a wholesale 7 drug distributor licensed and regulated by the New York board of pharma- 8 cy and registered with and regulated by the United States drug enforce- 9 ment administration. Such distributors are exempt from storage, report- 10 ing, recordkeeping, and physical security control requirements for 11 schedule II controlled substances containing any material, compound, 12 mixture, or preparation that contains any quantity of pseudoephedrine. 13 S 3. This act shall take effect on the ninetieth day after it shall 14 have become a law; provided however, that effective immediately, the 15 addition, amendment and/or repeal of any rule or regulation necessary 16 for the implementation of this act on its effective date is authorized 17 to be made and completed on or before such effective date.
