         printed to be committed to the Committee on Agriculture
       AN ACT to amend the agriculture and markets law, in relation to increas-
         ing penalties associated with the packaging, sale or certification  of
         kosher foods
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Subdivision 6 of  section  201-c  of  the  agriculture  and
    2  markets  law, as added by chapter 151 of the laws of 2004, is amended to
    3  read as follows:
    4    6. Failure to comply with the requirements  of  sections  two  hundred
    5  one-a  and  two  hundred  one-b  of this article and this section or the
    6  failure to conform sales practices to the information  provided  in  the
    7  kosher  certification  form pursuant to this section shall be punishable
    8  by a fine of not more than [one] TWO thousand FIVE HUNDRED dollars for a
    9  first violation; not  more  than  [five]  SEVEN  thousand  FIVE  HUNDRED
   10  dollars  for  a second violation; and not more than ten thousand dollars
   11  for a third violation and each subsequent violation thereafter.
   12    S 2. This act shall take effect on the sixtieth  day  after  it  shall
   13  have become a law.
