        AN  ACT  to amend the public health law, in relation to tinting on motor
          vehicles
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
     1    Section  1. Subdivision 16 of section 206 of the public health law, as
     2  added by chapter 135 of the laws of 1994, is amended to read as follows:
     3    16. The commissioner, in consultation with  the  commissioner  of  the
     4  department  of  motor  vehicles,  shall promulgate rules and regulations
     5  specifying the medical conditions  based  on  health  and  safety  which
     6  justify  granting  an exception to the requirements of subparagraphs one
     7  and two of paragraph  (b)  of  subdivision  twelve-a  of  section  three
     8  hundred seventy-five of the vehicle and traffic law. Such medical condi-
     9  tions,  shall  include,  but  not  be  limited  to,  polymorphous  light
    10  eruption, lupus, porphyia, xeroderma pigmentosa, and severe drug  photo-
    11  sensitivity.
    12    § 2. This act shall take effect immediately.
